This Indenture made the 5th fifty day of July Anno Domini one Thousand Eight Hundred ten Between John Yardley Administrator &c of Benjamine Yardley deceased of the one part & James Reeves of the other County of Buncombe and State of No. Carolina of the other part Witnesseth that the said John Yardley For & in consideration of the Sum of one hundred & Sixty pounds PAID TO HIM THE SAID John Yardley The receipt whereof is hereby acknowledged he the said John Yardley admr &c Doth by these presents bargain & Sell alien Enfeoff convey & Confirm unto him the said James Reeves his heirs and assigns Forever the Following Tracts or parcels of Land Situate lying and being in the County of Buncombe aforesaid (to wit) one Tract Situate lying and being on Both sides of Sandy Mush Creek Begining on the North Side of said Creek on a large pine on the side of a steep Hill near a large Rock runing thence west one hundred & Eighty poles to a white oak on the Bank of a small branch then South ninety two poles to a Stake then East one Hundred and Eighty poles to a Stake then to the Begining Containing one hundred acres one other Tract on both sides of Sugar Creek of Sandy Mush Begining on the Side of a hill on three — woods on Davidson & Henrys line runing thence South two hundred & Seventy poles up said Creek to a Stake then west one hundred & ten poles Crossing Said Creek to a Stake then North two hundred & twenty poles to a Stake then to the Begining Containing one Hundred and Fifty acres One other tract on both Sides of Sugar Creek of Sandy Mush Begining on two branches on the side of a hill new the mouth of a branch joining his other Tract runing then West Fifty Eight poles Crossing Said Creek to a white Oak on the top of a ridge then South thirty poles to a Black oak on the Side of a Mountain then South forty five west Ninety Six poles to a Red Oak on the top of a ridge then South forty five East One Hundred & Twenty Six poles Crossing said Creek to a Stake then North Thirty five East Ninety Six poles to a Stake then North Thirty poles to a Stake then to the Begining Containing one hundred Acres. One other Tract on both Sides of Sugar Creek of Sandy Mush Begining on the west side of Said Creek on the side of a Steep Hill Five poles from said Creek on three white Oaks and runs South forty five West one hundred & eighty Four poles up said Creek to a Stake Then South forty five East one hundred & thirty two poles to a Stake then North forty Five East one hundred and Eighty four poles to a Stake thence to the Begining Containing one hundred & fifty Acres One other Tract on both Sides of Sandy Mush Creek Begining on a Spanish oak on the South side of said Creek and Runing west Crossing the Fork one hundred & Fifty five poles to two small pines then North Crossing the Creek one Hundred and Fifty five poles to a Stake then west one hundred & Fifty Five Poles to a Stake Then South Crossing the Creek to the Begining containing one hundred & Fifty Acres be the same more or Less: the first Four Tract of Land ~ Being part of a Large Tract of Land originally Granted to David Allison by the State aforesaid and sold to James Hughey high Sheriff of Buncombe aforesd. To satisfy the County and Public Taxes due thereon for the year 1796 as will more fully appear by the said Sheriff Deed to John Strother bearing date the 29th Septr. 1798 and Registered in the Registers Office of Buncombe aforesaid the 28th of Decemr. 1798 and John Strothers deed to the Said Benjamin Yardley bearing Date the 18th of November 1799 and the Fifth and last Mentioned Tract of Land being a Tract first Granted to Joseph Henry and William Davidson by a Patent Bearing date the 7th of July 1794 and by them Conveyd to William Weir (?) by a deed bearing date the 20th of April 1796 and by said Weir to Joseph Henry by a Deed bearing date the 2d of January 1798 ~ And also all the waters woods ways water & water and water Courses and all and Every the appurtenances thereunto Belonging or in any wise appertaining of the aforesaid land and premises & every part thereof and all the Estate Right title Interest Claim & property whatsoever of the said Benjamin Yardleys heirs & lawful Representatives of and to the land and premises hereby granted to have & to hold the same to the aforesaid James Reeves his heirs And assigns Forever and the said John Yardley as Administrator aforesaid For himself and his heirs & the Heirs of the Said Benjamin Yardley & against the Claim or Claim of all & Every other person or persons whatsoever to the Said James Reeves his heirs and Assigns will the land and premises aforesaid ever Warrant & Defend In Witness whereof the said John Yardley Administrator &c by his Lawful Attorney in fact Joseph McDowel Carson hath hereunto set his hand & Seal the day & year first above Written
