This indenture made the 20th day of January in the year of our Lord one Thousand Eight hundred & forty five between James H. Witherspoon Comr of the Court of Equity of the one part and John Taylor of the other part Witnesseth Whereas the said John Taylor stands indebted to the said James H. Witherspoon Comr as aforesaid by his Bond bearing date January 20th 1845 conditioned for the payment of Two hundred Dollars & one cent in the following manner viz the sum of one hundred Dollars & ½ cent on the 6 Jany 1846 and also the sum of one hundred Dollars ½ cent on the 6th Jany 1847 with Interest on the whole from 6 Jany 1845 until paid. Now this Indenture Witnesseth that the said John Taylor for and in consideration of the said debt or sum payable as aforesaid to the said James H. Witherspoon Comr as aforesaid and for the further securing the payments thereof to the said James H Witherspoon Comr as aforesaid according to the tenor & terms aforesaid and also in consideration of the sum of one Dollar by him the said James H. Witherspoon Comr as aforesaid to the said John Taylor in hand paid at and before the sealing and delivering of these presents do Grant Bargain Sell Alien Release convey & confirm unto the said James H. Witherspoon and to his successors in office forever all that piece, parcel, plantation or tract of land situate in Lancaster District on both sides of Rocky River Road & bounded by the lands of Lancaster Road in part containing Two hundred & one acres more or less bounded by lands of Elisha Garris, Susanah Baskin, Dudley Hail, John Taylor & also bounded by the twenty acre tract sold Jas C. McMullins by James Reeves decd having such form marks & boundaries as a plat annexed to the deed from the said Witherspoon to me represents reference being had thereto to more fully describe & locate said land, the plat shows the 20 acres laid off to James C. McMullan the tract being known as the James Reeves old place. Together with all and singular the Rights, members, and appurtenances thereto belonging or in anywise appertaining and the _ & _, Remainder & Remainders, Rents, issues and profits thereof. Tho have and to hold the said piece or parcel of land with the appurtenances unto the said James H. Witherspoon Comr as aforesaid & his successors in office forever - Provided always Nonetheless - and it is the true intent and meaning of the parties to these presents that of the same John Taylor or his heirs Executors or Admrs shall will and truly pay or come to be paid to the said James H. Witherspoon Comr as aforesaid or his successors in office the sum of Two hundred Dollars & one cent according to the tenor, terms, & payments above mentioned then & from henceforth these _ shall be utterly null and void, anything herein contained to the contrary thereof in anywise notwithstanding, and it is covenanted & agreed upon by & between the parties to these presents, that until default shall be made in payment of the aforesaid sum as before set forth and the Indenture for the same it shall and may be lawful to & for the same John Taylor peaceably and quietly to hold use occupy profit & enjoy all and singular the premises above granted released and any part thereof with the appurtenances and to have receive and take the rents, issues and profits thereof to his own particular use and ___; anything herein contained to the contrary thereof in anywise notwithstanding - In witness whereof the said parties to these presents have hereunto set their hand and seal this day and year full above written
