Transcript

In the name of God Amen I Burwell Rives of the County of Union and State of Kentucky being in low state of health but of sound mind and memory do make this my Last Will and Testament -
Imprimis I will and divise that of my personal estate or so much may be sold as will pay my just debts -
2nd My will and desire is that all my lands lying and being in the County of Franklin State of Virginia may be sold for the best price it will bring in such way and manner as my executors think proper and the proceeds of such sale to be equally divided between my eight children namely Elizabeth Rives, Nancy Rives, Peter Rives, Patsey Rives, Matilda Rives, Polly Rives, Lucy Rives and Sally Prunty now the wife of Thomas Prunty and their lawful heirs forever -
3rd My will and desire is that my only son Peter Rives have three hundred dollars out of the sales of my land be laid out in land in the western Country if he chooses and if not to be put in Interest until such time he arrives to the age of Twenty one
4th My will and desire is that all my estate (?) and personal be sold and equally divided between my Eight children Tw wit Elizabeth Rives Nancy Rives Peter Rives Patsey Rives Matilda Rives Polly Rives Lucy Rives and Sally Prunty now the wife of Thomas Prunty and their lawfull heirs and it is to be understood that the negro boy Harry now in the possession of Thomas Prunty and all other property that I have given to my daughter Sally Prunty as making a part of her portion and she is to have such other part of my estate as will make her portion with what she already has equal with my other daughters -
5th My will and desire is that if any of my children should die without lawfull heirs that such part of my estate that I have given them may be equally divided between my surviving children -
6th My will and desire is that all my eight children may have an equal portion of my estate except my son Peter Rives is to have three hundred Dollars out of the sales of my land to be applied as is before directed over and above his proportionable part of my estate -
7th I do hereby appoint Joel Shruews Berrly Charles Lumsdin and Joseph Rives my executors to this my last will and Testament this 23rd September 1811

This Instrument of writing was produced in court and proven to be the Last will and Testament of Burwell Rives deceased by the oaths of Robert Abrey James Abrey and John W Lumsdel the subscribing witnesses thereto and ordered to be recorded.
