Transcription

This Indenture made and Entered into this 16th day of January 1840 Between William Rolen and Elisabeth Rolen his wife of the State of Alabama and County of Lauderdale of the one part, And Jessee Reves (sic) of the State of Alabama and County of Lauderdale of the other part Now this Indenture Witnesseth this that the Said William Rolen and Elisabeth his wife of the first part, for and in Consideration of the Sum of Two hundred Dollars to them in hand paid, at or before the Signing Sealing and delivery of these presence by the Said Jessee Reves (sic) of the Second part the receipt whereof is hereby acknowledged, have granted bargained and Sold enfeoffed and conveyed and by these presence do grant bargain Sell and Convey to the Said Jesse Reves (sic) of the Second part his heirs and assigns forever one Certain tract or lot of ground, Situated being and lying in the County of Lauderdale and State of Alabama designated and known as the East half of the South west quarter of Section Twenty four in Township and Range Thirteen West of the bases median of Huntsville Containing Seventy nine acres and Seventy Seven hundredths of an acre, to have and to hold the aforesaid tract or lot of Land with all and Singular the appurtenances thereunto belonging unto the Said Jesse Reves (sic) and his heirs forever, and the Said William Rolen and Elizabeth his wife on their part of the first part do hereby Covenant and agree to and with the Said Jessee Reves (sic) his heirs and assigns forever that they will warrant and forever defend the right title Claim and Interest of the said tract or lot of land unto the Said Jesse Reves (sic) and his heirs against them and their heirs and all person or persons Claiming by through or under any other person or persons, or by through or from the government of the United States and unto the Said Jesse Reves (sic) his heirs and assigns forever. In Testimony whereof the Said William Rolen and Elisabeth his wife have hereunto Set their hands and affixed their Seals this day and date above written

Lauderdale County         §         Personally Came before me the
Undersigned Justice of the peace in & for Said County, William Rolen and Elizabeth his wife and acknowledged the within Indenture to be their and each of their acts and deed. She the Said Elizabeth being of Lawful age Separate and apart from her Said Husband by me Examined and the full Contents of this Indenture to her made Known whereupon She did declare She did Volentarily and of her free will Sign Seal and deliver the Same without any fear threats or compulsion of Said Husband whatever.
