Transcription

Ila Reeves was acting as a commissioner appointed by the Hancock County Probate Court to convey 40 acres of land for which James Steel had executed a title bond to Isaac Fitzpatrick, but had died without executing the deed of conveyance: NW¼ of SE¼, Sec 5, Twp 16N, Range 8E.

This Indenture made this tenth day of May in the year of our Lord one thousand eight hundred & forty one between Ila Reeves commissioner appointed by the Probate court of the county of Hancock, state of Indiana to make convey & deliver a good & sufficient conveyance of the following described real estate of the one part & Isaac Fitzpatrick of the county & state aforesaid of the other part Witnesseth that whereas James Steel deceased was in his lifetime lawfully seized & possessed in fee simple of the following described real estate & in his lifetime made & executed unto Isaac Fitzpatrick his title bond for the conveyance of the following described real estate, situate in the county of Hancock & state of Indiana which is known & described as follows (towit) the north west qr of the south east quarter of section No. 5 township No. 16 north of range 8 east containing forty acres And being so seized as aforsaid died without executing the said deed of conveyance to the said Isaac Fitzpatrick. And whereas at a Probate court held in for said county aforesaid on the second monday of February in the year A.D. 1841 on petition of Isaac Fitzpatrick setting forth the aforesaid facts and praying the court to appoint a commissioner to make a legal conveyance in accordance with the said title bond as aforesaid & the premises therein having been fully seen & considered by the court it was ordered that the aforesaid Ila Reeves be appointed by said court to make & deliver unto the said Isaac Fitzpatrick & deed & conveyance of said premises in accordance with the stipulations of said title bond. And the aforesaid Isaac Fitzpatrick having paid seventy five dollars being the full amount of the consideration as stated in the said title bond. I Ila Reeves commissioner as aforesaid & by order of the probate court as aforesaid, I do hereby execute & deliver to Isaac Fitzpatrick a good & sufficient deed in fee simple to him his heirs & assigns all & singular the aforesaid described real estate together with all the rights privileges & appurtenances thereunto belonging. And all of the estate right, title & claim of the said James Steel in his lifetime in & to the same. To Have & to Hold the premises aforesaid with the appurtenances to the said Isaac Fitzpatrick his heirs & assigns forever in as full & ample a manner & subject to all the conditions and limitations & covenants as the said premises were had & held by the said James Steel in his lifetime & at the time of his death. In witness whereof I Ila Reeves commissioner as aforesaid & by order of the court as aforesaid hath hereunto set my hand & seal the day & year first above mentioned
