1861 Estate - Malachi Reeves

Deed - Parks Hardman, Executor, Estate of Malachi Reeves to John P. Boring

Pursuant to the last will and testament of Malachi Reeves late of said county, deceased, after public notice for thirty days made in the Marietta (Georgia) Patriot, on the first Tuesday in November Eighteen hundred and fifty nine, Parks Hardman executor of the last Will and Testament to said Malachi Reeves, deceased, at Marietta in said county did put up and expose to sale on twelve months credit, Lots of Land, numbers Eighty nine and one hundred and twenty eight (89 & 128) in the Sixteenth (16th) district and second section of originally Cherokee, but now Cobb County, each lot containing forty acres more or less when When (sic) John P. Boring being the highest and best bidder said Lots of land was knocked off to him at and for the price of seven hundred and seventy two dollars.

Now therefore this indenture made and entered into this fifth day of March in the year of our Lord eighteen hundred and sixty one between Parks Hardman executor of the last Will and Testament of Malachi Reeves late of said county deceased of said state and county of the one part, and John P. Boring of the same place of the other part. Witnesseth That for an din consideration of the sum of seven hundred and seventy two dollars cash in hand paid at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, the said Parks Hardman executor as aforesaid, hath and doth by these presents grant, bargain, sell and convey unto the said John P. Boring all of that tract or lots of land situate, lying and being in the sixteenth district and second section of originally Cherokee but now Cobb County, known in the plan of said district by the numbers eighty nine and one hundred and twenty eight Containing forty acres each ore or less with all the rights, members, and appurtenances to said lots of land in any wise appertaining or belonging . To have and to hold the said lots of land unto hi the said John P. Boring his heirs, executors, administrators, and assigns forever in fee simple. And he said Parks Hardman executor as aforesaid the right and title of said Lots of land will for ver warrant and defend against himself, and against all other persons whatsoever so far as the office of executor authorizes him.

In testimony whereof the said Parks Hardman executor as aforesaid hath hereunto set his hand and affixed his seal the day and year above written.
