Transcript

Know all men by these presents yt whereas Mr. Francis Collins of Salem in ye county of Essex in New England decd did in & by his last Will & Testament give and bequeath all his reall estate unto his two sons John and Benj whereby ye widow of said Francis Collins Decd cannot dispose of any part of said Reall estate for her comfortable subsistance & she being now in want wherefore we whose names are under written being all ye surviving children of ye said Francis Collins decd and ye daughters husband viz John Collins only son Hannah Collions alias Brown widow William Reaves and Eliz his wife Elizer Keyson in behalf of his wife Mary Decd a daughter of the Decd John Dixey and Sarah his wife daughter as aforesaid Christian Collins alias Bray widow Samuel Neale & Abigail his wife daughter as aforesaid do all agree covenant and promise yt In case & provided ye aforenamed Elizer Keyson and John Dixey shall well and truly pay or cause to be paid unto ye said widow Hannah Collins the sum of sixteen pounds in money provision or other things to her acceptance within one year from ye date hereof as she shall have occasion thereof or in case any other of ye children shall pay any part of ye said sixteen pound they and each that so disburst shall be reimbursed and paid what they shall so pay out of ye reall estate either of John Collins his part of Benja Collins Decd his part or in any which they shall choose after ye widows Decease together with ye ? thereof after ye rate of six pcent paimen? untill ye same be paid & the abovesaid sixteen pounds to be paid to ye said Hannah Collins widow for her comfortable subsistance and ? over & above ye five pounds to be paid to said widow by John Dikey for ye rest of Benjamins land at Marblehead and in case ye said widow should dye before ye expiration of ye said year ye charge thereof shall be paid by each on their proportion thereof either inland or mony as aforesaid to these ye shall disburst together w ye interest thereof as aforesaid untill it is paid for ye true performance of & singular ye articles covenants and agreemt herein contained and expressed we do bind vs oblidge ourselves each of us our & each of our heirs executors and administrators each unto ye other in ye Penall sum of thirty pounds current mony of New England In testimony whereof we have hereunto set our hands & seals this first day of Decembr 1702
