North Carolina
This Indenture made this 10th day of March Anna Domini 1738 In this 10th year of the reign of our Soverign Lord George the Second by the Grace of God of Great Britain & Between John Span Gent of the one part and William Recives (sic) of Bertie Prect of the other part. Witnesseth that the said Jno Span for & in consideration of twenty five pounds currency of Virginia or five thousand W (?) of merchantable pork to him in hand paid or secured to be paid at two payments by the said William Recives (sic) the receipt whereof the Said Jno Span doth hereby acknowledge & hath given granted bargained sold aliened released enfeoffed & confirmed & in & by these presents doth give grant bargain alien release enfeof & confirm unto the said William Recives (sic) & to his heirs forever one certain tract or parcel of land lying & being in Edgecomb Precinct & on the South side of Morrottock River and on the North side of Great Quankey swamp being part of patent granted to the said Robert Wood for three hundred & forty four acres of Land bearing date the 24th day of July 1728 Containing all that dividend of land on the North side Quankey Swamp and within the said patent and the said parcel of land containing by Estimation two hundred acres of land be the same more or less to the Use & behoof of the said William Receives (sic) & heirs Exor & Admrs & forever Together with all rights & privileges Immunities to the same belonging or in any wise appertaining To have & hold the said parcel of land & is bounded as follows (to wit) Beginning at a pine on Quankey Creek and so running to another pine thence to a Red oak & thence to a Poplar unto all the bounds within mentioned unto him the said William Recives (sic) his heirs Exors Admrs & assigns shall & may Quietly, enjoy the said described land with all the appurtenances to the same belonging or in any wise appertaining and further the said John Span his heirs Exers Admrs or assigns or — from any other person or persons claiming any by or under me or them and any or either of them shall & will at the special Instance & request of him the said William Recives (sic) his heirs & assigns the said parcel of land warrant & defend against all or any person or persons claiming any right title or Interest thereunto & will at any time do any lawful act or Instrument of writing, as shall be thought necessary for confirming & making sure the said land & plantation to the sd William Recives (sic) his heirs &c forever In Witness whereof I have hereunto set my hand & affixed my Seal the day & Year first above written - Signed Sealed & delivered In presence & sight of us
