1739 Deed - John Spann to John Crenshaw Mentioning Reeves Line

This Indenture made the 17th day of Nov’r Anno Domini 1739 Between John Span & Mary his Wife of Bertie County & in the province of No. Carolina of the one part & John Crenshaw of Edgecombe County of the other part Witnesseth that for & in consideration of the sum of twenty five pounds lawful money of Virginia to me in hand paid before the ensealing & deliver of these presents the receipt whereof he doth hereby acknowledge himself fully satisfied & contented thereof of every part & parcel thereof doth exonerate acquit & discharge the said John Crenshaw his heirs forever by these presents have given granted bargained & sold (unreadable) conveyed & confirmed and by these presents do fully quietly & absolutely give grant bargain sell alien convey & confirm unto him the said John Crenshaw his heirs & assigns forever one (unreadable) tract or parcel of land in the said county of Edgecombe in the province of No. Carolina Containing by estimation one hundred & fifty acres of land be the same more or less being bounded as followeth Viz. Beginning at a corner hickory in a branch on the south side of a great Creek in Reeve’s line thence E to a corner hickory a corner of Wm Collins line then S 101 poles to a corner red oak & persimmon S 140 poles to a corner pine then W 110 poles to a corner red oak then W along a line of marked trees to a corner white oak in the said branch then down the branch the several courses thereof to the beginning the said land being patented for said John Spann the 2nd day of March 1739 To have & to hold forever the said granted & bargained premises with all & every the appurtenances privileges & commodities to the same belonging or in anywise appertaining with all houses orchards gardens fences wood land grounds pastures pasture grounds swamps meadows water & water courses with all and every other rights privileges therein & thereon contained to him the said Jno Crenshaw & his heirs & assigns forever to his & their proper use & behoof forever And I the said Jno. Spann & Mary his wife for ourselves our heirs Exor’s admr’s & assigns do covenant promise & agree to & with the said Jno Crenshaw his heirs Etc has we the said John Spann & Mary his Wife before the ensealing of these presents are the true sole & lawful owners of the above bargained premises and are lawfully and rightfully seized & possessed of the same in my own right as a good perfect & absolute estate of inheritance in fee simple & have in myself good rights full power & lawful authority to grant bargain sell convey I confirm the said bargained premises so above mentioned and that the said Jno Crenshaw his heirs & assigns shall & may from time to time & at all times forever hereafter by force & virtue of these presents lawfully peaceably & quietly have hold (unreadable) occupy possess & enjoy the above mentioned land & premises with the appurtenance (unreadable) acquitted exonerate & discharged of & from all manner of former & other gifts grants bargains sales leases mortgages wills entails dowers (unreadable) executions incumberances & intents furthermore I the said Jno Spann & Mary my Wife for ourselves our heirs Etc do covenant & engage the above demised premises to him the said John Crenshaw his heirs & assigns against the lawful claims & demands of any person or persons whatsoever forever hereafter to warrant secure & defend the said land & premises with all & every of the appurtenances herein and therein mentioned made known or explained In Witness Whereof I the said Jno Spann & Mary my Wife have hereunto these presents affixed our hand & Seals the day month & year above written.

The above Deed was proved in open Court by the oath of Jos Crenshaw one of the subscribing witnesses thereto On Motion ordered to be registered.

Note: This is one of two deeds from Span to Crenshaw on November 17, 1739 that mentions land on “the south side of a Great Creek in Reeves line”. The second deed was for a parcel containing 250 acres. On August 17, 1741 (Deed Book 4, pp.421-422) John Crenshaw and wife Elizabeth sold 250 acres to John Spann, land on the great Creek on the south side of Reaves line.

Also, on 10 Mar 1738, John Span had sold 344 acres on the north side of Great Quankey Swamp to William Reeves.
