Transcription

This Indenture made this twenty eighth day of August in the year of our Lord one Thousand Seven hundred and forty one Between William Reeves of the province of North Carolina and of Edgecombe County of the one part and William Smith of Bertie County of the other part, witnesseth that he the said William Reeves, Junr and in consideration of the sum of Eight pounds Sterling money of England to him paid in hand paid by the said William Smith before the signing and insealing (sic) of these presents already paid the receipt whereof he doth hereby acknowledge and himself fully contented, satisfied and paid and every part and parcel thereof the said Wm Reeves, Jnr. His heirs, executors and &c and every of them doth hereby fully, clearly and absolutely acquit and discharge, Hath bargained sold and doth by these presents bargain sell, alien made over and confirm unto the said William Smith his heirs, executors, or assigns one certain tract or parcel of land containing one hundred acres be the same more or less situate, lying and being in Edgecomb County in the afores’d province, bounded, as followeth to wit: Beginning on the South Side of Chokeyott Creek at a red oak that was formerly called John Mustons lower corner, on the said creek thence running South westerly course to a white oak Mustons upper corner, thence along a straight line of markt trees to little Chokeyott Creek thence down the said Creek to Great Chockeyott Creek thence down the main course to the beginning or first station mentioned. To have, hold and peaceably to enjoy the aforesaid one hundred acres of lands with all houses, orchards, gardens woods ways, waters, under woods, and meadow grounds with all other and singular the improvements and appurtenances thereunto or in any wise appertaining to the said lands from the claim right or title of him the said Wm. Reeves, Jnr. His heirs executors adm. or assigns or any other person or persons whatsoever to the only use and behoof of him the said William Smith his heirs executors adm or assigns&c forever, and he the said Wm. Reeves Junr. For himself, his heirs executors admr &c do covenant promise and agree that he will from time to time and at all times forever hereafter against all persons whatsoever the right of the said land and premises warrant and defend to the said Smith his heirs or assigns &c and that he the said William Reeves Jnr. Shall and will be ready at any time hereof __ to make any further right conveyance or title that he the said William Smith his heirs or assigns &c or his of their council learned in the law shall lawfully require. In Witness whereof the said William Reeves Jnr. Hath hereunto set his hand and affixed his seal, the day and year first above written.
