Transcription

This Indenture made and Indented this Thirty first Day of January one Thousand Seven Hundred & Forty Nine BETWEEN Philemon Bradford of the County afsaid Farmer of the one part & William Rieves Junr of the County & Province afsaid Farmer of the other part Witnesseth that I the said Philemon Bradford for & in Consideration of the Sum of Fifty Pounds Current Money of the Colony of Virginia to me in hand paid or Secured to be Paid by the said William Reves have given granted Bargained Sold & by these presents do give grant bargain Sell Convey & confirm unto the said William Reves his Heirs Executors Admintors & Assigns one Messuage Plantation or Tract of Land Containing by Estimation Three Hundred and fifty acres more or less Situate lying and being in the County afsaid and Bounded on little Fishing Creek beginning at Hatchers’ Creek and so down the said Creek to Fishing Creek to Carter Hodg — this his Line so a long his line to My East line so a long my East line to a Corner Pine from thence South West to Hatchers Creek the first Station TO HAVE AND TO HOLD the afore recited & fore (?) bargained premises with the appurtenances thereof free & clear from me the said Philemon Bradford my heirs Exetors Admtors with all Houses Orchards Gardens with the Privilege of hawking Hunting Fishing and Fowling with part of all Mines & Minerals to the same belonging to him the said William Reves his Heirs Exetors Admtors or Assigns free & clear from all gifts grants bargains Sales Leases Mortgages Joynters Dowers Judgments etc & of all other Incumbrances whatsoever and Further I the said Philemon Bradford for myself my Heirs Exetors Admtors etc do Covenant grant & agree that I the said Philemon Bradford have good Right full Power of lawful Authority to Sell & Dispose of the Same having in My myself an Indefeazable (sic ?) Estate of Inheritance in Fee Simple Further I the said Philemon Bradford for My self My Heirs Exetors Admtors do Covenant and grant and agree to & with the said William Reves and his Heirs and Assigns to Warrant Secure and Defend the aforesaid Land & premises from me my Heirs Exetors Admtors & from the Just Claim of any other person lawfully claiming the Same his Lordships and Covenants in his grants only Excepted and any Other Conveyance to Make at the Proper Cost of Charges of the said William Reves or to their Council Learned in the Law shall Reasonably Devise advise or Require In Witness whereof I the said Philemon Bradford have hereunto set my Hand & affixed My Seal the day & year aforesaid.
