Transcript

This Indenture made this Thirteenth Day of July in the year of our Lord Christ one thousand seven hundred and seventy by and between Fredrick Rives of Pittsylvania County and Colony of Virginia of the one part and David Kirby of the County and Colony aforesd of the other part witnesseth that the said Fredrick Rives for and in consideration of the sum of Two Hundred and fifty pounds current money of Virginia to him in hand paid by the said David Kirby at and before the insealing and Delivering of these presents the Receipt whereof he doth hereby acknowlegde thereof and convey part thereof doth clearly acquit and discharge the said David Kearby his Heirs Executors and Administrators and every of them by these presents hath Given granted Aliened bargained sold Released and confirmed and by these presents doth give grant Alien bargain sell release and confirm unto the David Kearby and his heirs and assins forever one tract or parcell of land containing fifteen hundred acres more or less situate lying and being on Both sides of Pigg River in the County of Pittsylvania and Colony of Virginia and Bounded as followeth to wit Beginning below the gre...d of Pigg River at the mouth of a Branch in the north side of the River at a red oak thence up said branch to the head to a poplar thence on the Deviding Ridge Between the glade Creek and the River to a red oak on the west side of Black Water path thence to a red oak and Hickory on the River North side thence down said River to a water Spanish oak on the south of the River thence to a walnut on the River on Lewis Morgans line about the mouth of Cheknot thence down the River to a red oak of the mouth of the ROckey Creek thence to the dividing line above William Stegalls thence along the deviding line to the mouth of mountain Creek thence down the River to the first station with all and singular the appurtenances thereunto belonging unto him the said David Kirby Clear of all incumbrances and his heirs to the only proper use and behoof of him the said David Kerby his heirs and assigns forever and the said Fredrick Rives, for himself his heirs executors and Admrs doth covenant and Grant to and with the said David Kearby that it shall and may be lawfull to and for the said David Kirby his Heirs Executors Administrators from time to time and at all time forever hereafter peaceably and quietly to have hold occupy and possess and enjoy the said lands houses out houses woods waters watercourses fences fealds orchards with the Right and Title of him the said Fredrick Rives and his heirs without any lett sute Trouble molestation and interuption of him the said Fredrick Rives his heirs executors Administrators or assigns or any of them or any other person or persons lawfully claiming or to claim in by from or under any of them and the said Fredrick Rives for himself and his heirs the said land and premises as before intended and mentioned and exprest unto him the said David Kearby and his heirs against him the said Fredrick Rives and his heirs and all claiming or to claim in by or under them or any of them and the said Fredrick Rives shall and will warrant and forever defend from all claim whatsoever by these presents In witness whereof he hath hereunto set his hand and affixt his seal the day and date first above written

Memorandum That on the thirteenth Day of Jumy one thousand seven hundred and seventy peaceable and quiet possession of the land premises within granted and sold was had and taken by the within named Fredrick Rives and by him Delivered to the within mentioned David Kearby as usual symbols of livery and seizen according to the first formme and esent of the within Deed
