Transcript

This Indenture made the Twenty Third day of April in the year of our Lord One Thousand seven Hundred & Seventy seven Between George Reeve of the one part and John Hutchison of the other part, witnesseth that the said George Reeve for and in consideration of the rents and covenants herein after mentioned on the part of the said John Hutchison to be paid and performed hath demised, granted let and to farm letten & by these presents doth demise grant, let & to farm let unto the said John Hutchison the lower part of a tract of land of Four Hundred & Twenty five acres with the appurtenances lying and being in the County of Dunmore in the Colony of Virginia on Flint Run & being bounded on the line of Phillip Croome & on the line of John Cal? and on the line of Reuben Paggot and on the line of Henry Hardin formerly Binghams the lower part of the abovementioned land as aforesaid to have and to hold the said land and premises to the said John Hutchison and his assigns for and during the natural lives of the said John Hutchison and Marget Hutchison his wife and for and during the natural life and lives of the longest liver of them, yielding and paying therefore yearly and every year during the said term to the sd George Reeve his heirs and assigns the Rent or sum of Five pounds current money of Virginia of which payments the first is to become due on the first day of January which shall be in the year of our Lord One Thousand seven hundred & Seventy Eight & if it shall happen the said yearly rent of five pounds or any part thereof should be behind hand and unpaid by the space of four months after the day appointed for the payment thereof and the same being lawfully demanded at the messuage of the said John Hutchison by the sd George Reeve or assigns upon the demised premises and there shall not be goods & chattels of the sd John Hutchison or his assigns sufficient by distress to satisfy & pay the Rent so in (?) that then it shall in that case be lawful to and for the said George Reeve his heirs and assigns unto and upon the said Land and premises to Reenter & the same to again retain and enjoy as if his or their former estate. This Indenture or any thing therein contained to the contrary or any wise not withstanding & the said John Hutchison for himself his executors administrators & assigns doth covenant promise and agree to and with the said George Reeve his heirs and assigns by these presents in the manner following, (that is to say that he the said John Hutchison or his assigns shall and will within five years after the date of these presents plant upon the said demised premises three Hundred Good Fruit Trees & one third part of them at least to be good apple Trees & the same to inclose with a good lawful fence & he doth agree likewise to erect or build & finish and compleat on the said Tenament in a good sufficient and workmanline manner a dwelling house at least twenty feet long & sixty feet wide to be of framed work; also a barn Forty two foot by Twenty the floor to be laid with plank & he doth agree after the building of the said houses to keep the same in good repair with all and singular the messuages and fences which are to be built or at any time during the said term shall be built upon the said Tenement & at the end of the Term aforesaid will so yield up & leave the same to the sd George Reeve his Heirs or assigns & it is further covenanted & agreed by and between the parties to these presents that all taxes, imports & assessments which shall be at any time or times during the said Term hereby demised by law taxed set or imposed on the said demised premises shall be from time to time paid & discharged by the said John Hutchison his Heirs, Executors and administrators the sd John Hutchison doth hereby promise and oblige himself to work or cause to be worked the sd premises no more force than three hands and the said John Hutchison & his assigns shall not commit or suffer to be committed any waste upon the demised premises nor without leave of the said George Reeves or his assigns, sell or dispose of or suffer any timber or wood thereon to be disposed of otherwise than for the buildings & fences & the necessary uses of the said plantation or plantations, & the said John Hutchison doth further covenant and agree to and with the said George Reeve his heirs and assigns that if the said John Hutchison shall at any time make a breach or failure of any part of the above covenants that then it shall and may be lawful for the said George Reeve his heirs & assigns to re-enter the said land and premises & the same to enjoy again & retain as if this deed had never been drawn or made. In witness whereof the said George Reeve and the said John Hutchison have hereunto interchangeably set their hands and seals the day and year first above written.

At a court held for Shanando County the 30th of September 1779 This Lease for lives from George Reeves to John Hutchison was proved by the oaths of Nicholas Harding & Ralph Crum witnesses thereto and was ordered to be certified

This lease was further proved by the oath of Samuel Bland another witness thereto and ordered to be recorded.

Commentary

Note that only the "lower part" of the 425 acres is leased in this deed. The "upper part" was leased the same day to Isaac Dale. The grantor is identified as George Reeve (c1730 VA - c1779 VA) of Prince William County by the fact that his children and widow (James Reeves, Jonathan Reeves and Jane Jones) sell this same piece of land in a later deed.
