This indenture made the twenty seventh day of September in the year of our Lord one thousand seven hundred and eighty five and in the tenth year of the Independence of the United States of America Between Spencer Reeve of the county of in the State of the one part and William Greaves now or late of Savannah in the said State of the other part Witnesseth that for and in consideration of the sum of fifty pounds sterling to him the said in hand at and before the sealing and delivery of these presents by the said William Greaves well and truly paid the receipt whereof the sd Spencer Reeve doth hereby acknowledge and thereof and of every part and parcel thereof doth acquit release exonerate and discharge the said William Greaves his Heirs Executors and administrators and every of them forever by these presents and the said Spencer Reeve hath granted bargained sold aliened released and confirmed and by these presents doth fully freely clearly and absolutely grant bargain sell alien release and confirm unto the sd William Greaves in his actual possession now being by virtue of a bargain and sale to him thereof made by the said Spencer Reeve for one whole year for the consideration of the shillings sterling by an Indenture of lease bearing date the day next before the day of the date of these presents to commence the day next before the day of the date hereof and sealed and delivered before the executing of these presents and also by force of the Statute for transfering of uses into possession in that case made and provided and unto his heirs and assigns forever a certain plantation or tract of land lying and being in Washington County containing two hundred and eighty seven and a half acres be the same more or less which was granted by his Honour Samuel Elbert Esqr Governour of the said State bearing date the fifth day of March one thousand seven hundred and eighty five and butting and bounding Northeastwardly by John Fenn Land Southeastwardly by John Youngs Land Southwestwardly by vacant Land and Northwestwardly by Nathaniel Wades Lands together with all and singular the gardends orchards fences ways wells water water courses casments profits commidities advantages emoluments, hereditaments appurtenances whatsoever to the said track of two hundred eighty seven and half acres of land belonging our in any wise appurtaining and the reversion and reversions remainder and remainders rents issues and profits thereof and of every part and parcel thereof and also all the Estate right title interest possession property profit claim and demands whatsoever either in law or Equity which he the said Spencer Reeve now hath or ever had or which he or his heirs here after shall may can or ought to have of into or out of the said tract of two hundred eighty seven and half acres land and other the premises with their appurtenances together with all deeds platts Grants Charters Writings and muniments Whatsoever he the said Spencer Reeve now hath in his custody or possession or can come by without suit in law or equity that do only concern the premises. To have and to hold the said tract or two hundred and eighty seven and half acres of land and all and singular other the premises hereby granted and release or meant and intended to be granted and released unto the said William Greaves his heirs and assigns to the only proper use and behoof of the said William Greaves heirs heirs and assigns forever and the said Spencer Reeve for himself and his heirs the said premises hereby bargained sold granted released or meant and intended to be bargained sold granted and released with every of their appurtenances unto him the said William Greaves his heirs and assigns against all manner of person or persons whatsoever shall and will warrant and forever defend by these presents and the said Spencer Reeve for himself and his heirs executors and administrators do covenant promise grant agree to and with the said William Greaves his heirs and assigns by the presents in manner and form following that is to say that the said now at the time of the sealing and delivery of these presents is and standeth lawfully and absolutely seized of and in the said Plantation or pract of land containing two hundred and eighty seven and half acres and all and singular other the premises herein before mentioned and intended to be hereby granted and released and every part and parcel NB* thereof with their and every of their appurtenances NB* unto the said William Graves his heirs and assigns forever as aforesaid and also that it shall and may be lawfull to and for the said William Greaves his heirs and assigns from time to time and at all times for ever hereafter peaceably and quietly to enter into have hold occupy possess the said tract of two hundred and eighty seven and a half acres of land and all and singular other the premises herein before mentioned and intended to be hereby granted and released and every part and parcel thereof with their and every of their appurtenances without any the lawful let suit trouble molestation eviction or interuption of the said Spencer Reeve his heirs executors or adminsitrators or any other person or persons whatsever claiming or to claim by from or under him or them and that free and clean and freely and cleanly and absolutely acquited exonerated and discharged of and from all and all manner of other and former and other gifts Grants bargains sales uses wills intailes jointers dowers judgments executions changes and incumbrances whatsoever had made done commited or suffered by the said Spencer Reeve or any other person or persons whatsoever lawfully claiming or to claim by from or under him and lastly that the said Spencer Reeve and his heirs and all and every other person and persons lawfully claiming or to claim any estate right title trust or interest of in or to the said tract of two hundred and eighty seven and a half acres of land and all and singular other the premises herein before mentioned and intended to be hereby granted or any part or parcel thereof shall and will from and at all times hereafter at the reasonable request and proper costs and charges in the law of the sd William Greaves his heirs and assigns make do acknowledge and execute or cause and procure to be made done acknowledged and executed all and every such further and other lawful reasonable act and acts thing and things conveyances and asurances in the law whatsoever for the further fuller and more perfect and absolute granting conveying and assuring said tract of two hundred and eighty seven and a half acres of land and all and singular other the premises herein before mentioned and intended to be hereby granted and released and every part and parcel thereof with their and every of their appurtenances to and for the use and behoof of the said William Greaves his heirs and assigns forever as by him or them or by his or their council learned in the law shall be reasonable devised or advised and required in witness whereof the said parties to these presents have here unto interchangeably set their hands and seals the day and year first above written

Omission to be inserted at NB* of a good sure perfect and absolute estate of Inheritance in fee-simple without any manner of condition trust provise power of revoeation or limitation of any use or uses or other restaints matter or thing whatsoever to alter change charge defeat or evict the same and also that the said Spencer Reeve now hath in himself good rightfull power and lawful & absolute authority to grant release and confirm the said tract of two hundred and eighty seven and a half acres of land more or less and all and singular other the premises herein before mentioned and intended to be hereby granted and released and every part and parcel thereof with their and every of their appurtenances

Commentary

Spencer Reeve was granted this land 13 Sep 1784 and began the transfer with a lease the same day.
