This Indenture made the tenth day of February in the year of our Lord One thousand seven hundred & eighty six & in the eleventh year of American Independence by & between Thomas Reaves living in the State of Georgia on Brier Creek planter of the one part & John Findly of the Waxsaws Lancaster County planter of the other part wintesseth that the sd Thomas Reaves for & in consideration of the sum of eighty five pounds fourteen shillings sterling the receipt whereof is hereby acknowledged & for divers other goods causes him thereunto moving hath granted bargained & sold transferred released & confirmed & by these presents do grant bargain & sell transfer release & confirm unto the sd John Finly in his actual possession now being by virtue of a bargain & sale to him thereof made for one whole year by indenture bearing date the day next before the day next before the day of the date of these presents & by force of the statute for transferring of uses into possession & to his heirs & assigns forever a certain plantation or tract of land containing one hundred & forty acres situate lying & being on a branch of wateree River called Fishing Creek & hath such shapes form & marks as appears by a plat thereof to wit Grant annext which sd grant was unto the (?) Alexander McCown under the hand of the honorable William Bull Esqr Lieutenant Governor recorded in the secretaries office in Book FFF page three hundred & seventy five the Reference thereunto being had may fully appear together with all and singular the gardens orchards fences ways (?) watercourses casements & profits commodities advantages hereditaments whatsoever to one hundred and forty acres of land above mentioned on fishing creek where the sd Thomas Reaves formerly lived laid of by W(?) Carson one hundred & forty acres being part of land granted to the sd Alexander McCown three hundred acres of land by his majesties latter patent bearing date the twenty first day of April one thousand seven hundred & seventy four together with (?) & profits claim or demand whatsoever either in (?) equity which he the sd Thomas Reaves how hath or ever had he or his hereafter shall may or can and ought to or out of the sd one hundred & forty acres all the Deeds plots Grants charters & writings that he the said Thomas Reaves now hath in his possessions or can come by without suit in law or equity that do concern the premises - To have & to hold the sds land of one hundred & forty acres to the said John Finly to his heirs & assigns forever & the sd Thomas Reaves for himself & his heirs the said premises hereby granted bargained sold released ir meant or intended to be granted with their appurtenances unto him the sd John Findly his heirs & assigns against all manner of persons whatsoever shall & will warrant & forever defend by these presents the sd Thomas Reaves for himself & his heirs exrs & Admrs doth covenant & promise & agree to with the sd John Finly his heirs & assigns by these presents by manner & form following that is to say that he the sd Thomas Reaves at the time & Delivering these presents is & standeth lawfully & in the sd one hundred & forty acres of Land & every part & parcel thereof & also the sd that the sd Thomas Reeves hath in himself good rightful powers & lawful authority to grant release & confirm to sd one hundred & forty acres of land & all & singular other the premises herein beforementioned & intended to be hereby granted & released & every part & parcel thereof with every of their appurtenances unto the sd John Finley his heirs & assigns forever & also that it shall & may be lawful to & for the sd John Finly his heirs & assigns from time to time & at all times forever hereafter peaceably & quietly to enter unto have hold occupy possess & enjoy the sd one hundred & forty acres of land & all & singular the premises herein before mentioned & every part & parcel thereof their & every of their appurtenances without any suit or trouble or interruption of the sd Thomas Rivers his heirs Exrs Admr or assigns or any other person or persons whatosever claiming or to claim by from under him & from all other charges or incumbrances whatsoever or whatsever shall lawfully claiming or to claim from under him & lastly that the sd Thomas Rivers & his heirs & all and every other persons claiming lawfully or to claim estate right title or interest of in or to the sd one hundred & forty acres of (?) & at the reasonable request & proper charges in the law (?) sd John Finly his heirs & assigns make do acknowledge & (?) or to be done Acknowledge & executed all & every (?) other & for the reasonably act & acts thing & things con__ances & apurances in the law & all other & singular the premises herein before mentioned & intended to be Granted & released & every part & parcel thereof with their to & every of their Appurtenances to & for the (?) & behoof of the sd John Findly his heirs & assigns forever as by him or them or by his or their counsel (?) in the law shall be reasonably devised or (?) requireth witness whereof the sd Thomas hath hereunto set his hand & seal the Day & year above written
