State of South Carolina
This Indenture made this twenty third day of January in the year of our Lord one thousand seven hundred & ninety seven & of the american Independence the twenty first Between William Rives & Mary his wife of Chester County & State aforesaid of the one part & David Hyatt of State & county aforsd of the other part Witnesseth that the said William Rives & Mary his wife for & in consideration of the sum of Eighty pounds sterling to him in hand well & truly paid by the said David Hyatt at & before the sealing & Delivering of these presents the receipt whereof the said William Rives doth hereby acknowledge & from every part & parcel thereof doth acquit & discharge the said David Hyatt his heirs & assigns forever, and for divers other good causes & considerations us hereunto moving hath granted bargained sold aliened enfeoffed & confirmed and & by these presents do grant bargain sell alien enfeoff & confirm unto the said David Hyatt his heirs & assigns forever all that plantation or tract of land containing two hundred & forty acres more or less on both sides of fishing creek beginning at said creek running S 51 W" to a stake, thence N14 W 39 to a stake thence N76 E to said creek & part of another tract on said creek running So 75 W to a white oak, thence No 14 W 22 60 to a hickory sapling thence N 76 E to a stake, thence So 76 E 26 12 to a stake thence So 14 E to Thomas Neeley's line along said line to a small run or branch and down said branch to fishing creek Granted to Jacob Beasley by his excellency William Bull Esquire & at his decease invested by heirship in Margret Beasley George Beasley and Adam Beasley by them conveyed to William Rives as appear by the records of Chester County Court and by said William Rives to David Hyatt. Together with all & singular the woods trees waters water courses profit commodities appurtenances & hereditaments whatsoever thereunto belonging or in any ways thereunto belonging or appertaining to the said tract or parcel of land containing two hundred & forty acres more or less & all the Estate right title Interest claim & Demand whatsoever both in law & equity of the said William Rives of & into the said premises & every part & parcel thereof To have & to hold the said two hundred & forty acres of land more or less & all & singular the premises above mentioned with appurtenances to the said David Hyatt his heirs & assigns forever. And lastly the said William Rives & Mary his wife their the said two hundred & forty acres more or less & all & singular the premises above mentioned & granted with the appurtenances unto the said David Hyatt & his heirs against all persons whatsoever shall & will warrant & forever defend. In witness whereof the said William Rives & Mary his wife have hereunto set their hands and seals the day and year first written.
