This is the second wife of Timothy Rives of Sussex County, Virginia.

Transcript

In the name of God Amen. I Rebecca Rives of the County of Sussex do make and ordain this my Last Will and Testament in manner and form following Vizt - Imprimis I give and bequeath to my nephew Seth Mason my negroes Jordan Austin Roger and Dick to him and his heirs - Item I give to Rebecca Rives daughter to my nephew John Rives my negro Girl Hannah and her increase to her and her heirs forever - I give to Peyton Mason son of my brother Payton Mason my negro boy Charles to him and his heirs - Item I give to Peyton Mason son of John R. Mason the sum of one hundred and seventy dollars to be paid out of the sales of my estate. Item I lend unto my nephew Seth Mason and to my niece Jane Mason his wife during their lives separately my negro woman Lysia and her three children Stephen, Ned, and Caty and their future increase and at the death of the said S. Mason and Jane his wife I give to his three children Rebecca Lucretia and William James Mason the said negroes Lydia, Stephen Ned and Caty and their increase to be equally divided among them but in consideration of this legacy it is my will and desire and I hereby order that my nephew Seth Mason pay to Sarah M. Jeffries my niece the sum of two hundred and fifty dollars which said sum shall be to her and her heirs. Item I give and bequeath to Charles B. Rives my son in law the sum of one hundred dollars to be paid out of the sales of my estate. Item I give to Sarah M. Jeffries to Rebecca J. Mason and to Lucretia Mason to each of them respectively one bed and one third first of all my Bed furniture comprising blankets sheets &c. &c. Item I desire that my waring apparel may be equally divided in kind among my niece Sarah M. Jeffries, Jane Mason and her daughter Rebecca J. Mason. Item I give nephew Seth Mason all my household furniture not before disposed of and I hope and request that my nephew wdl not expose it to sale to the highest bidder. Item I give to my brother Peyton Mason my riding Gig and harness. Item I desire my debts be paid out of the sales of the residue of my property and also the legacy to Peyton Mason son of John and the legacy to Charles B. Rives and after paying the said debts and legacies I give the residue to my nephew Seth Mason and his heirs. Lastly I constitute and appoint my nephew Seth Mason sole to this my last will and testament hoping and desiring that he may and be compelled to give security for his executorship. In witness whereof I have hereunto set my hand and seal this ninth day of may one thousand eight hundred and eleven.

At a Court held for Sussex County the 6th day of April 1815. The last will and testament of Rebecca Rives was presented into court by Seth Mason the exor therein named the same was proved by the oaths of the two subscribing witnesses and ordered to be recorded. And on motion of said exor who made oath and entered into bond conditioned as the law directs certificate is granted him for obtaining a probate thereof in due form.
