Transcript

This Indenture made the eighteenth day of June one thousand eight hundred and sixteen between Ephraim Donevan of Fleming County and State of Kentucky of the one part and Asa Reeve Junior of the County and State aforesaid of the other part witnesseth that the said Ephraim Donevan for and in consideration of the sum of Forty dollars to him in hand paid by the said Asa Reeve before the execution of this indenture the receipt of which is hereby acknowledged by the said Ephraim Donevan have granted bargained and sold and by these presents do grant bargain and sell, alien and confirm unto the said Asa Reeve his heirs and assigns forever the following described tract or parcel of land situate lying and being in the County of Fleming on the waters of Fleming creek being part of a tract of Ten thousand acres pattented in the name of Littleberry Mosby heir at law of John Mosby deceased (and is part of the tract on which said Donevan now lives) and laid off as follows to wit Beginning at a hackberry stump corner to Asa Reeve senr (where a stone is now placed) thence south 71 East 42 poles to a stake thence south 65 west 20 poles to a stake thence south 75 west 14 poles to a stake thence North 83 west 14 poles to a stone thence North 19 East 23 poles to the Beginning containing by estimation Four acres together with all & singular the priviledges & appurtenances & the reversions remainders rents issues & profits thereof & all the estate right title and interest property, claim and demand of him the said Ephraim Donevan his heirs executors administrators and assigns of in and to the same To have and to hold the land and premises above described and every part and parcel thereof with the appurtenances To the only proper use benefit and behoof of him the said Asa Reeves his heirs and assigns forever and the said Ephraim Donevan for himself and his heirs the land and premises above described and every part and parcel thereof with the appurtenances unto the said Asa Reeves his heirs executors administrators or assigns against the title claim or demand of him the said Ephraim Donevan his heirs or any person whatsoever claiming by through or under them shall and will warrant and forever defend and further if any person or persons whatsoever shall at any time lay claim to the said land by any title better than that of the said Donevans and shall enter and prosecute (?) and recover the whole or any part of the land hereby conveyed from the said Asa Reeve his heirs or assigns then and in such case the said Ephraim Donevan or his heirs shall & will pay to the said Asa Reeve his heirs or assigns at the rate of Ten dollars per acre with legal interest from the date hereof for the land of which the said Asa Reeves or his heirs shall be so evicted. In witness whereof the said Ehpraim Donevan hath hereunto set his hand & seal the day & year first above written
