State of Georgia
This Indenture made the first day of July Eighteen hundred and twenty eight between David Morrison Sheriff of the County of Newton in said State of the one part and John E Rieves of the County of Hall in said State of the other part. Whereas in obedience to a write of Fiera Facias (?) from and out of the Superior Court of Hall County in Said State at the instance and suit of Thomas Reed his natural guardian Stephen Reed against Ambrose E Blackwell the said David Morrow Sheriff of aforesaid did lately Survey? on the one half of or (?) undivided Moiety of lot of land Number one hundred and fifty Seven (157) in the one district of formerly Henry now Newton County in Said State being one hundred and one and a quarter acres as the property of Ambrose K Blackwell and after being duly advertised according to law did on the day of the date hereof it being the first Tuesday in July in the year aforesaid at the place of publick sales in the County of Newton expose the same at publick outcry when the saidJohn E Rieves being the highest and best bidder the same was knocked off to the said John E Rieves at the price or sum of ten dollars. Now this Indenture witnesseth that the said David Morrow sheriff as aforesaid for and consideration of the sum of ten dollars to him in hand well and truly paid by the said John E Rieves at and before the sealing and delivery of those presents the receipt whereof is hereby acknowledged hath granted bargained sold and by these presents doth grant bargain sell and convey unto the said John E Rieves his heirs and assigns all that tract or parcel of land containing one hundred one and a quarter acres ore or less being the one half of lot No One hundred and fifty seven (157) in the tenth (10) district formerly Henry County now Newton County in said State together with all and singular the rights members and appertenances thereof to the same belonging or in anywise appertaining and also all the estate right title interest property claim and demand of the said Ambrose E Blackwell in law equity or otherwise howsoever of in or to the same. To have and to hold the before described land unto the said John E Rieves his heirs and assigns to their only proper use forever in for simple in as full and ample a manner as the said Ambrose K Blackwell or his heirs or assigns did or might have enjoyed the same had it not been seized upon and sold under execution as aforesaid and I the said David Morrow Sheriff as aforesaid do hereby warrant the title so far as the same was vested in the said Ambrose K Blackwell to be sold according to law as sheriff aforesaid and no further.
