1833 Deed of Trust - Thomas Rieves to Claiborn Harris

Know all men by these presents that I Thomas Rieves of the County of Maury & State of Tennessee have this day bargained and sold to Claiborn Harris of the same County and State aforesaid for the consideration of one dollar and for the further consideration hereafter mentioned the following property viz One sorrel mare about four years, Nine head of stock hogs five stands of bee hives one loam household & kitchen furniture, now in possession Nevertheless this deed is made for the following express purpose and hono other viz that Whereas the said Thomas Rieves is indebted to Eligah Rieves in the sum of Fourty seven dollars the payment of which is secured by one note of hand due 1st May 1833. Now it is understood and agreed that the above article of property is to remain in the possession of the said Thomas Rieves till the 25th of December 1833 and that he is to have the use of the same till then, and if the said debt of $47.08 any part of it shall remain unpaid on the said 25th of December 1833 this the said Clairborn Harris shall take said property into possession and after giving ten days public notice of the time and place of sale proceed to sell the same or so much of it as is sufficient to pay said debt to the highest bidder for cash and out of the proceeds of the same shall pay off and discharge the said debt & return the balance of said property or the proceeds of said sale to said Thomas Rives, now if the said debt of Forty seven dollars shall be paid off & discharged on or before the said 25th day of Decr 1833 then this deed to be void otherwise to remain in full force in consideration of all of which the said Eligah Rieves agrees to await the payment of said till said 25th December 1833 in testimony of which I have hereunto set my hand & seal this 20th day of May 1833 in presence of

I Thomas J Porter clerk of the Court of Pleas and quarter sessions do certify that Thomas Rieves who executed the within deed of Trust personally appeared before me and acknowledged the execution thereof for the purposes therein contained and set forth - given under my hand at office this 21st day of May 1833
