Transcript

This Indenture made & entered unto the 1st day of August in the year of our Lord 1833 between George W Rives of the County of Lincoln and the State of Tennessee, William P. Smith & Sarah his wife formerly Sarah Rives of the County of Giles and State aforesaid of the one part and John Sherman of the county of Giles and State aforesaid of the other Witnesseth that the said parties of the first part George W Rives William P. Smith & Sarah Smith his wife have this day bargained, sold, aliened, conveyed, and confirmed, and by these presents do bargain, sell, alien, convey and confirm unto the said John Sherman a certain tract or parcel of land lying and being in the county of Maury and State aforesaid on the Bank of Duck River, and bounded as follows (to wit) Beginning on the North bank of Duck River a small distance below the Fork commonly called Lewis Ford where the west boundary line of Benjamin Herndon's 4000 acre tract crosses said River. Thence up the said River westwardly with its meanders one hundred poles or thereabouts to a stake on the Bank of said River thence South along a line newly marked one hundred and forty two poles to a post oak on the North bank of said River thence up the River Eastwardly with its meanders, one hundred poles or thereabouts to a stake on the Bank of said River, thence south along a line newly marked one hundred and forty two poles to a post oak on the North bank of said River thence up the River Eastwardly with its meanders, one hundred poles to a sugar tree being the beginning corner of the said Herndon's said 4000 acre tract & Holland's 4000 acre tract & Hind's five thousand acre tract, thence with said Herndon's west boundary line to the beginning, containing seventy nine acres & 64 poles be the same more or less being a part of a five thousand acre tract originally granted to Joseph Hinds. To have & to hold the aforesaid tract or parcel of land with all and singular the rights profits, emoluments, hereditaments, and appurtenances of in & to the same, or in any wise thereunto belonging or appurtaining to the same, to the only proper use of him the said John Sherman his heirs or assigns forever, and the said George W. Rives, William P. Smith & his wife Sarah Smith aforesaid for themselves their Heirs, Executors & Administrators do covenant and agree to & with the said John Sherman his heirs and assigns that the beforementioned tract or parcel of land they will warrant & forever defend unto the sd Jno Sherman his heirs & assigns forever against the right, title, claim or demand of all and every other person or persons whatsoever claiming or to claim the same in law or equity. In testimony whereof the parties of the first part aforesaid have hereunto set their hands & affixed their seals the day and year first above written

Giles County} Term 1833
Personally appeared in open court at said Term George W. Rives and William Smith parties to the within deed who acknowledged the same to be their act and deed for the purposes therein contained and Sarah Smith the wife of said William P. Smith being privately examined by the court separately and apart from her husband, and on her examination saith that she executed said Deed freely and voluntarily and without any constraint or improper interference of her said Husband. Whereupon it was ordered that said deed be certified for registration. In testimony whereof I Sterling H. Lester clerk of said Court have hereunto set my hand and affixed my private seal (having no seal of office) at office this 6th day of August 1833.
