Transcript

I Isaac Reeve of the town of Minisink in the County of Orange and State of New York considering the uncertainty of this mortal Life and being of a sound and composing mind and memory Blessed be the Almighty God for the same do make and publish this my Last Will and Testament in manor and form following to wit
first I order and direct that all my just debts funeral expenses and Grave Stones put to my Grave be paid out o my estate by my executors hereinafter named
2d I give and bequeath to my daughter Sally Jane now Sally Jane Tyron the sum of one thousand dollars including my Book account the Balance after deducting my Book acct that I now have or may have against her and her husband Schuyler B Tyron to be paid to her in a year after my decease
3d I give and bequeath to my daughter Harriet Reeve the same amount of house hold furniture in value quantity and quality and stock that I have heretofore Given or let my daughter Sally Jane Tyron have and to be delt out by my wife if she should be living if not by my other executors and delivered to her when she comes to the age of eighteen years or as soon thereafter as may be and all the beds beding &c that she is making and claiming as her own and so much money that will mak one thousand dollars the money to be paid to her when she comes to the age of twenty four years if she lives & if not then to her decendants if she leaves ay and not otherwise with interest after she comes to the age of twenty one years the interest to be paid to her annually also a privaledge of one room in my now dwelling house and agress and egress to the same and her support of my homsted farm or that part of said farm I hereafter devise to my son Wickham C Reeve as long as she remains single and unmarried the Beds Beding &c shes now making not to be accountded in the tousand dollars
4th I give and bequeath to my wife Sally Reeve the Residue and Remainder of my house hold furniture and one choice horse a one horse wagon a set of single haress two carns the horse and cows to be kept on my homsted farm or that part that I hereafter devise to my son Wickham C Reeve during her widowhood the above bequeath is in lew of her right of Dower in the farms Now in possession of my son William L Reeve and the farm called and known as the Murray farm.
5th I give and bequeath to my son William L Reeve one thousand dollars including my Book account or that he the said William have the use of the said Legace during his natural life and if he dies leaving heirs then to be theres if not leaving any heires or heirs the same to be returned to my other heirs I also give and devise to my said son William L Reeve and to his heirs and assigns for ever all that certain farm piece and parcel of land and premises situate lying and being in the town of Mount and it being the farm he now lives upon and upon the following and exspress condition that is to say that if he the said William L Reeve his heires executors or administratrs shall do well and truly pay or cause to be paid to my executors herein after named for said farm the sum of thirty dollars for each and every acre in said farm in two years after my decease with the interest and all the interest that is unpaid on the principal or back interest and if my said son William L Reeve should not choose to take said farm upon the condition aforesaid or neglect or refuse to perform in all things in and about the premises then and in that case I order direct and impower my said executors at their discression to sell and convey the fee simple of said farm and out of the sale of said farm or out of the settlement of the same to allow him the balance of the legace before mentioned.
6th I give and bequeath to my son Benjamin B Reeve one yok of oxen one ox yoke one large chain on plow and two cows the whole to be worth one hundred and forty dollars and eight hundred and sixty dollars including my book account the Balance to be allowed to him in the settlement or out of the sale of the farm called and known by the name of Murray farm. I further give and devise to said son Benjamin B Reeve and to his heirs and assigns for ever all that part of my farm called the Murray farm that lies west of the Road leading from Nathan Hulse to Charles Everson including a small piece of the West end of the old Reeve farm the said piece is now included in the swamp pasture and runs and is bounded by stone wall on the west end of the field west of the orchard and is a now a part of the Murray farm and is attached to a field on said farm upon the following and express conditions that is to say that if he the said Benjamin B Reeve his heires executors or administrators shall do well and truly pay or cause to be paid unto my executors hereinafter named for said farm the sum of fifty two dollars and fifty cents for each and every acre in said farm in three years after my decease and in hree annual payments with interest from the first day of April after my deease if I should die between the first day of September and April in any year otherwise from the time of my decease and to be paid annually the balance of the legace to be allowed and taken out the money of said farm & paid to him when the farm is sold and if it should so hapen that my said son Benjamin B Reeve should not chouse to take the said farm or neglect or refuse to comply in all things in and about the premises or conditions thereof in such case then I order and direct and empoewr my said executors hereinafter named to sell and convey said farm to any person or persons at there discression and out of the monies coming into there hands from the sale of said farm to pay my said son Benjamin B Reeve the Balance of the legace before mentioned & further order and direct that if my said son Benjamin B Reeve shall chouse to tak the said farm and comply with the conditions thereof then I give & bequeath to my said son the timber of three acres of lands of the North East Corner of my homsted farm to commence at the Brook and Run along David Corwin Line up to the meddow said timber to be taken of in four years after my decease and to be made use of on the farm that I have devised to my said son Benjamin for fuel and fencing and not otherwise and to be taken of in the winter season of the year so as not injure the farm by passing through
7th I give and bequeath to my son Isaac N Reeve the sum of one thousand dollars the same to be paid to him when he come to the full age of twenty three years with the interest for two years which said sum I order to be made out of my homsted farm which I have devised to my said son Wickham and I do hereby mak the sum a lien on my said homsted farm and I do further order and direct that my said son Isaac have a privaledge in my dwelling house and his support of my said homsted farm as long as he remains single and unmarried
8th I give and bequeath to my son Wickham C Reeve all my farming utencials and stock not otherwise disposed of with grain and hay and provisions subject hower to the keeping of my wife horse and cows and the support of Isaac and Harriet I also give and devise to my said son Wickham C Reeve and to his heirs and assigns for ever all that my homsted farm that I now live upon not otherwise disposed of subject however to the payment of one thousand dollars to my son Isaac N Reeve and the keeping of a horse and two cow for my wife and the privalede in the house & support of Isaac & Harriet while they or either of them remains single.
9th I order and direct & my will is that my daughter Polly M Nanitten? have what she has had and what she has in possession and that my executors purches & suspend twenty five dollars for clothing for her at my decease
10th I further order and direct that all the surplus monies be held by my wife Sally & by her & at her direction disposed of amongst my severall children as they or any of them may mad? as long as she remain my widow but should she cease to be my widow and there should be in her hands any of the surplus monies of my estate then I order the same equally divided amongs my severall children or there descendants so that each share alike in the distribution thereof.
Mastly I do hereby nominate and appoint my wife Sally Reeve executrix & my son Wickham C Reeve & Schuyler B Tyron executors of this my last will and Testament hereby revoaking all former wills heretofore by me made in witness whereof I have hereunto set my hand and seal the sixth day of November in the year one thousand eight hundred & thirty nine 1839

The within instrument was now here subscribed by Isaac Reeve the testator in the presents of each of us & was at the same time declared by him to be his last will Testament & we at his request sign our names thereto as attesting witnesses

Whereupon I the surrogate aforesaid upon the proof aforesaid being satisfied of the genuineness & validity of the said will do therefore order that the same be admitted to probate and that Letters Testamentary thereon be granted to Wickham C Reeve & Schuyler B Tryon executors in the said will named they first taking the oath or affirmation required of them by law
