This indenture made the first day of October in the year of our Lord one thousand eight hundred and fifty one between Miles M. Norton Esquire Commissioner of the Honorable court of Equity for Pickens District in the said State of one the one part and Wiley Reaves of the same District and State of the other part whereas Jane Barton and P Alexander Admx & Admr did on or about the eighth day of June 1847 exhibit their bill of complaint in the court of equity at Pickens Court House in the said State against John Ladd and Wiley Reaves for the execution of title to a tract of land sold to the said Wiley Reaves by Bailey Barton decd in his life time and the cause being at issue before the honorable court came on to be heard at June Term 1851 when the said court after full hearing and mature deliberation in the premises did order adjudge and decree that the said Miles M Norton as Commissioner as aforesaid should execute titles thereto on the terms and for the purposes mentioned in the said decreetee order as by reference thereto in the registry of the said court will appear. Now therefore this Indenture winesseth that the said Miles M Norton as Commissioner of the said court under and by virtue of the said decree and in consideration of the sum of three dollars paid him by the said Wiley Reaves the receipt whereof is hereby acknowledged hath granted bargained sold and released and by these presents doth grant bargain sell and release unto the said Wiley Reaves his heirs and assigns all that certain tract or parcel of Land lying on the waters of Twelve Mile river now known as the Roper tract and which was conveyed said Bailey Barton by James Alexander containing one hundred and fifty acres more or less situate and bounded as follows beginning on a red oak on the old ridge path on Martin old line thence SW along Martins line to a stake thence So 80 W 5:50 to a hickory station thence So 60 W 12:50 to a red oak thence N 50 W 20 to a stake thence N 20 W 38 to a stake thence along said line to the old ridge path thence along said path to the beginning red oak corner it being thus described in the bond given by the said Bailey Barton to the said Wiley Reeves for titles. Together with all and singular the hereditaments rights members and appurtenances whatsoever to the said tract of land belonging or in any wise incident or apppertaining and all claim whatever of the heirs and representatives of the said Bailey Barton deceased and of all the parties to this suit and of all other persons whomsoever lawfully claiming the same or any part thereof. To have and to hold the said premises with its hereditaments priviledges and appurtenances unto the said Wiley Reeves his heirs and assigns forever.
