A petition was filed in Ashe County NC in 1839 requesting that the lands of Jane Reeves Baker be sold. The terms of Jesse Reeves' will dictated that the 300 acres should be the property of Jane's children at her death; however Robert and Jane Baker wanted to sell the land in order to move to another state where they might be able to prosper. The petition states that they were "helpless" and had a large family to support. They wanted to move to another state with more fertile soil in order to provide a better life for the children. In the Spring Term of 1840, the Ashe County Court agreed to the sale and decreed such.

It is likely that Jane Reeves and Robert Baker moved to Indiana for a short time before migrating to Georgia because their daughter Nancy, born in 1839, is recorded in the 1850 census as having been born there. The older children all born in North Carolina and the two youngest, Sophrona and Jesse were born in Georgia.

By the time the 1840 census was taken, the family was recorded in Cherokee County, Georgia. Robert Baker and their youngest children were also listed in the 1850 census in Cherokee County but Jane had apparently died for she was not present.
