Transcript

This Indenture made the Seaventh day of November in the Second year of the Dominion of the Rtt Honble Charles absolute Lord & prpry of ye provinces of Maryland Lord Baron of Baltimore etc and in the year of our Lord God One thousand Six hundred Seaventy & Seaven Between Edward Reeves of the County of Baltimore planter of the one part and Thomas Preston of the said County planter of the other part Witnesseth that whereas the said Lord Baltimore by his deed of grant under his great seale used in the sd provnce for granting of land there bearing date at St. Maryes the twenty sixt day of May in the year of his Lords Hs Dominion over the said province once anno Dom Thousand six hundred seventy & six did for the consideration therein mentioned grant unto the said Edward Reeves his hrs & assigns by the name of Edward Reeves all that parcell of land called the Chance lying in Balte County on the North side of Gunpowder Beginning at a bounded Red Oake running west north west eighty perches to a bounded chesnutt tree then north north east bounded on a small creek Two hundred perches then south to the first bounded tree containing & now laid out for forty three acres of land more or less to bee held of the manner of Baltimore together with all proffitts & benefitts thereunto belonging Royal mines excepted
To have and to hold the same unto him the said Edward Reeves his hrs & assigns forever under such rents covenants conditions limitations & exceptions as in & by the said Deed of Grant relation being thereunto had more at large may appear. Now this Indenture Witnesseth that the said Edward Reeves for & in consideration of Two Thousand pounds of good merchtbe Tobacco to him in hand paid & Delivered by the said Thomas Preston before the Sealing & Delivery hereof whereof & whereinth the said Edwd Reeves doth acknowledge himself to be wholy fully & clearly to be satisfied contented & paid and doth of & for every part & parcell thereof acquitt & discharge the said Thomas Preston his heirs Exrs & admrs & assigns by these presents hath granted bargained sold aliened enfeoffed & confirmed & by these presents doth fully clearly & absolutely grant bargain sell alien enfeoff & confirm unto the said Thomas Preston his hrs exrs admrs & assigns forever all that tract or parcell of land containing or laid out for forty three acres together with all the rights benefitts thereunto belonging or in any wise appertaining and allsoe all pattents Deeds Writings Evidences or manuscripts touching or concerning the premises or any part or parcell of them with all & signular the rights members jurisdiccons priviledges proffitts or benefitts thereunto belonging or in any wise appertaining To have & to hold the said parcell of land & all & singular the bargained premises unto him the said Thomas Preston his hrs & assigns for ever and the said Edward Reeves for hiself his hrs exrs & admrs doth hereby covenant & grant to & with the said Thomas Preston his heirs & assigns that he the sd Edward Reeves his hrs Exrs & admrs ye sd parcell of land and all other the bargained premises unto him the said Thomas Preston his heirs & assigns agt all manner of persons wsoever laying claim thereunto shall & well for ever hereafter warrant & defend by these pressents the rents & services wch from henceforth from time to time for & in respect of the premises shall grow due & payable to the chief Lord or Lords in respect to his or their Seignory or Seigniority (only excepted & foreprized) and further that the said Edward Reeves his hrs & assgns shall & will from time to time & at all times hereafter during the space of seaven years at the requeste & at the proper cost & charges in the law of him the said Thomas Preston his hrs or assigns make doe execute & suffer or cause to bee made done executed or suffered all & every such further & other act or acts thing or things Device or devices assurance & assurances wsoever requisite in ye premises for ye better assuring & more sure makeing of ye sd bargained premises unto him the said Thomas Preston his hrs & assgns for every bee it by enrollment of these presents fine ffeoffment or otherwise or by any other such lawfull ways & meanes as by him the said Thos Preston his hrs or assigns or by his or their councill learned in the law shall be reasonably devised advised or required & it is mutually agreed & continded by & between the parties to these presents that all & every such further & other assurance to be made as afsd of ye sd granted premises or any part thereof is meant & intended to bee & shall be to the only use & behoofe of the sd Thomas Preston his hrs & assigns for ever & to no oter use intent or purpose wtsoever in witness whereof the parties to these presents have hereunto interchangeably sett their hands & seales the day & yeare first above written

Memorandum yt Anne Reeves was privately examined before mee & then did freely confess that shee did voluntarily condiscend to the sale of ye wthin menconed land wthout threats or menaces.
