Transcript
This Indenture made this sixteenth day of October in the year of our Lord one thousand seven hundred and sixty one Between William Rieves of Dinwiddie County and Colony of Virginia of the one part and Jesse Potts of the County and Colony aforesaid of the other part Witnesseth that for and in consideration of the sum of twenty pounds lawful money of Virginia the said William Rieves hath acknowledged that he hath received full satisfaction for the same the receipt whereof the said William Rieves doth hereby acknowledge and thereof doth acquit and discharge the said Jesse Potts his heirs and assigns and the said William Rieves for the consideration aforesaid hath Granted Bargained sold alienated enfeoffed and confirmed and by these presents doth grant bargain sell alien enfeoff and confirm unto the said Jesse Potts & to his heirs and assigns forever a certain tract or parcel of land situate lying and being in Brunswick County and is to contain one hundred acres of land to the said in regular manner on both sides the cross roads where the flat rock road crosses the right hand fork of the road above Captain Robert Briggses joining the lands of Capt Robert Briggs together with all Houses orchards gardens timbers trees woods waters and water courses whatsoever to the same belonging or in any ways appurtaining and the reversion and reversions remainder and remainders rents issues and profits of all and singular the said land and premises with its appurtenances unto the said Jesse Potts his hiers and assigns to the only proper use and behooef of the said Jesse Potts his heirs and assigns for ever To have and to hold the said one hundred acres of and and the premises with its appurtenances unto the said Jesse Potts his heirs and assigns forever. To have and to hold the said one hundred acres of land and the premises with its appurtenances unto the said Jesse Potts his heirs and assigns to the only proper use and behoof of the said Jesse Potts his heirs and assigns for ever and the said William Rieves for himself and his heirs doth covenant Grant and agree to and with the said Jesse Potts and his heirs that the said William Rieves at the time of the ensealing & Delivery of these presents in and of(lands?) lawfully seized of and in the said land and premises with the appurtenances and of every part and parcel thereof of a good perfect and indefeasable estate in fee simple and that he hath good, right & lawfull authority to sell and convey the same as by these presents he hath done and that the said William Rieves and his heirs the said one hundred acres of land with all its appurtenances to the said Jesse Potts his heirs and assigns against all persons whatsoever shall and will warrant and forever defend by these presents. Memorandum That on the day and date of the within written Indenture full and peaceable seizen and possession of the within mentioned premises with its appurtenances was had and taken by the within named William Rieves and by him given and Delivered to the within named Jesse Potts to him his heirs and assigns forever according to the true intent and meaning of the within written Indenture.
