This Indenture made this Eighteenth day of June in the seventh year of the Reign of our Sovereign Lord George the Third by the Grace of God of Great Brittain France and Ireland King Defender of the Faith &c and in the year of our Lord Christ one Thousand seven Hundred and sixty seven Between John Rives and Amey his wife of the Parish of Albemarle in the County of Sussex of the one part and William Pettway junr of the Parish and County aforesaid Witnesseth that the said John Rives and Amey his wife for and in consideration of the sum of one hundred and forty pounds current money of Virginia to them in hand paid by William Pettway Junr the receipt whereof the said John Rives and Amey his wife doth hereby acknowledge they the said John Rives and Amey his wife hath granted Bargained sold aliened enfeoffed and confirmed and by these presents doth grant bargain sell alien enfeoff and confirm unto the said William Pettway Junr his heirs and assigns forever all that seat tract piece or parcel of land situate lying and being in the Parish of Albemarle County (?) on the south side of Notoway River being the lands which Richard Rives conveyed to the said John Rives by Indenture bearing date the sixteenth day of February One Thousand seven Hundred and fifty nine and Bounded as follows to wit Beginning at a Hicory on the river bank a corner of Neh. Masourborgs(?) line thence along the said Masunborgs line to a large pine thence along a line of marked trees be(?) the said Rives and Thomas Cureton to the said William Pettways line thence along the said Pettways land to the River thence along the various courses of the river to the place begun at to include one hundred and eighty five acres more or less Together with all the Houses gardens orchards and stables and also all the reversion and reversions remainder and remainders rents issues and services of all and singular the said premises and every part and parcel thereof and also all the estate right title interest claim & demand whatsoever of them the said John Rives and Amey his wife of in and to the said premises of in and to every part and parcel thereof with the appurtenances therewith belonging To have and to hold the said seat tract or parcel of land and all & singular the premises thereby granted bargained and sold & every part piece & parcel thereof with their and every of their appurtenances unto the said William Pettway junr his heirs and assigns forever to the only use and behoof of the said William Pettway junr his heirs and assigns forever and the said John Rives and Amey his wife and their heirs the said tenement fixed piece or parcel of land and premises above mentioned with the appurtenances unto the said William Pettway junr his heirs and assigns forever against them the said John Rives and Amy his wife and their heirs and all other persons shall and will warrant and forever defend by these presents In witness whereof the said John Rives and Amey his wife hath hereunto set their hands and seals the day and year above written

Memorandum that this Eighteenth day of June in the year of our Lord One thousand seven hundred and sixty seven I John Rives did by turf and twig deliver unto the within named William Pettway Junr possion of the land and premises within mentioned to hold unto the said William Pettway junr his heirs and assigns forever recording to the best intent and meaning of the within written deed In witness whereof I have hereunto set my hand & seal the day and year above written

This indenture & the memorandum of (?) & (?) therein indorsed were acknowledged by John Rives & Amey his wife & by the court ordered to be recorded previous to which she was privately examined & fully relinquished her right of dower (?) the land conveyed by the sd indenture.

Commentary

This is a rather curious deed as it concerns land that had been previously conveyed by Richard Rives to this John Rives. It's reasonable to assume that this is was a son of Richard's. However Child's in his book Reliques of the Rives identified John Rives of Bristol Parish as his son. However John and Frances of Bristol Parish are listed as parents of children in the Bristol Parish Register, the latest Thomas being born in 1753. He is listed with his wife Frances as early as 1746 as godparents for individuals in the Bristol Parish Register. The deed from 1759 and this deed from 1767 state that this John Rives lived in Albemarle Parish. If this is indeed the same individual, then he moved from Bristol to Albemarle Parish between 1753 and 1759 and had remarried between 1753 and 1767. Further investigation is need to determined whether these were the same individuals.
