Transcript

This Indenture made this 12th day of June in the year of our Lord One Thousand seven hundred and eighty seven. Between Peter Williams and Amey Rives executor, and executrix of John Rives, deceased, of Prince George County of the one part and Joshua Heath of the County of Brunswick of the other part. Witnesseth that whereas, the said John Rives deceased by his last Will and Testament bearing date the 26th day of February One Thousand seven hundred and eighty six, did direct that his executors should make sale of tract or parcel of land in the following words (to wit) I leave a certain tract or parcel of patented land, containing one hundred and twenty acres, lying and being at the lower end of the tract, I now live on & called and known by the name of Butler's. to be sold by my executors hereafter named, which said executors I do hereby impower to make good and sufficient Deed or Deeds of conveyance to souch purchaser or purchasers. And whereas the said Joshua Heath hath become a purchaser of the said One hundred and twenty acres of land for and in consideration of the sum of one hundred pounds current money to them the said Peter Williams and Amey Rives in there capacity in hand paid, the receipt whereof they do hereby acknowledge, they the said Peter Williams and Amey Rives in their capacity as aforesaid, Have and do by these presents, grant bargain & sell alien enfeoff and confirm unto the said Joshua Heath and to his heirs and assigns the said tract or parcel of land as above described, with all the estate, right, title, interest claim or demand whatsoever belonging to the said Tract or parcel of land and premises with the appurtenances, that there testator might have at the time of his Death. To have and to hold the said One hundred & Twenty acres of land with the appurtenances unto the said Joshua Heath his heirs and assigns to the only proper use and behoof of him the said Joshua Heath his heirs and assigns forever, and they the said Peter Williams & Amey Rives in their capacity as aforesaid, doth covenant, grant, promise & agree to and with the said Joshua Heath his heirs and assigns that the said Peter Williams and Amey Rives in their capacity as aforesaid the said tract or parcel of land and premises with the appurtenances, to the said Joshua Heath his heirs and assigns forever, shall and will warrant so far as their testator had a right to the said tract or parcel of land & forever defend the same by these presents. In witness whereof the said Peter Williams & Amey Rives in their capacity hath hereunto set their hands & seals the day & year first above written.
