This Indenture made this fourteenth of March Anno Domini 1791 Between Morris Richards, John Reeves, Hannah Elwell and Elizabeth Elwell of Cumberland County and State of North Carolina of the one part and John Alsobrook of the County and State aforesaid of the other part, Witnesseth that the said Morris Richards John Reeves Hannah Elwell & Elizabeth Elwell for and in Consideration of the Sum of Sixty pound lawful Money of Said State to them in hand paid John Alsobrook before the ensealing & Delivering of these presents the receipt whereof we do thereby acknowledge and every part and parcel thereof Doth fully freely and absolutely exonerate quit and forever Discharge the Said John Alsobrook his heirs execurs, adminirs and Assigns by these presents hath given granted bargained & Sold, aliened, enfeoffed and by these presents Doth give, grant, bargain, Sell, alien, enfeoff Convey and Confirm, unto the Said John Alsobrook a Certain Tract or parcel of Land Lying and being in Cumberland County and State aforesaid on the SoW Side of the No W River beginning at an ash Stump on the Side of the No W River running thence along Alexr Legg’s line So 70 W 42 poles to a pine, thence South 20 E 13 poles to a Stake in George Aclands line, thence down Said Line - No 75 E 400 poles to a Sycamore on the River George Aclands upper Corner thence along the river to the first Station as May More fully appear by the pattent bearing date March the 9th 1736 granted to Richard Dunn and by a Conveyance by the Sd Richd Dunn by Deed to Benjamin Elwell and the Sd Elwell Conveyed the Sd 30 acres of Land by Deed to Richd Elwell and his heirs forever, also we, Morris Richards, John Reeves, Hannah Elwell & Elizabeth Elwell do likewise give, grant bargain, Sell, alien, enfeoff, Convey & Confirm unto the above mentioned John Alsobrook another tract or parcel of Land, Lying & being in the Said County & State on the South West Side of the West River Beginning at a Small Maple Leggs lower back Corner, thence along Leggs line, 195 E 32 chain and 52 links to a pine, thence N 30 Chain & 75 links to a pine in Legg’s upper lines thence So 70 W 32 Chain & 252 links to a Cypress thence So 30 Chain & 75 links to the first Station Containing one hundred acres being part of 350 acres Beginning at the lower Corner of Tabulan (?) Clayton’s Land at an ash on the River, thence So 70 West 496 poles thence So 123 poles, thence No 70 E 496 poles to an ash on the river then along the river to the first Station as May More fully appear by the patent bearing Date 20th Feby 1735 Surveyed for Alexr Legg - and by his last will and Testament made over the Said Land to Richd Braswell and the Said Braswell to Robt Carver and the Sd Robt Carver to Isom Carver & the Sd Isom Carver by a Deed of Conveyance to Richd Elwell and we the aforesaid Morris Richards John Reeves Hannah Elwell & Elizabeth Elwell being heirs appearent at law do by their presents give, grant, bargain Sell alien enfeoff Convey and Confirm unto the afore Named John Alsobrook all that the above two tracts or parcels of Land to him and his heirs and assigns forever together with all the woods, waters, & water Courses Mines Minerals Hereditaments and appurtenances thereunto belonging or appertaining (one half of the gold & Silver Mines excluded) To have and to hold to the Said John Alsobrook his heirs and assigns forever y--ling (?) & paying the rents & duties that Shall hereafter become due as reserved in the Pattent & Complying with the Same together also with all the right, title, Interest, Claim & Demand of us the Sd Morris Richards John Reves, Hannah Elwell & Elizabeth Elwell who against him his heirs Exers admrs or any other person or persons lawfully Claiming or to Claim by from or under him them or any of them, the Same will warrant and forever Defend, and further we hereby oblige our Selves our heirs Executors or adminsrs at any time or times hereafter at the Instance request Cost and Charges of the Law of the aforesaid John Alsobrook his heirs or Executors to Sign Seal and Deliver any Such their Deed or Deeds as Shall and may be reasonably Devised advised or Requested by his or their Council Learned in the Law, for the further assurance & Better Confirmation of the premises aforesaid unto him Said Jo. Alsobrook his heirs and assigns forever – In Witness whereof we have hereunto Set our hands & Seals the day and year above written - -
