Transcript

This Indenture made this twelfth day of Des in one thousand Eight hundred and fifteen between Benjn Reeves and Jenny his of Fleming County and State of Kentucky of the one part and Elijah Reeves of the other part Witnesseth that the said Benjamin Reeves with Jenny his wife for and in consideration of the sum of one Dollar to them in hand paid by the said Elijah Reeves before the execution of the Indenture the receipt of which is hereby acknowledged have granted bargained and sold and by these presents do grant, release, convey and confirm to the said Elijah Reeves his heirs and assigns forever a certain tract or parcel of land situate lying and being in the County of Fleming on Foxes Creek being that part of Mosby 30,000 acres conveyed to the said Elijah Reeves By Elijah Reeves Senr and Peggy his wife by deed bearing date 13th day of January 1812 now remaining of record in the Clerks office of said County Court in deed book E page 7 and bounded as follows to wit Beginning at a Linn standing on the west bank of Foxes Creek in a line between the 10th & 11 Lots of Mosbys trace aforesaid thence with said line west to Spencer Reeves corner in said line the with Spencer Reeves line southwardly to Foxes Creek thence up the Creek as it meanders of the Creek to the Beginning containing by calculation one hundred and fourteen acres and one half be the same more or less Together with all and singular the premises and appurtenances to the same belonging or in any wise belonging or appurtaining and the reversions remainders rents issues and profits thereof and all the estate right title interest property claim and demand of them the sd Benjamin Reeves and Jenny their heirs and assigns of in and to the same. To have and to hold the premises above described and every part and parcel thereof with the appurtenances unto him the said Elijah Reeves his heirs and assigns to his and their only proper use and benefit forever And the said Benjamin Reeves and Jenny his wife for themselves and their heirs the land and premises above described and every part and parcel thereof with the appurtenances unto him the said Elijah Reeves his heirs and assigns against the title claim or demand of themselves and all every person or persons pretending to claim by through or under them (but against no other claim whatever) shall and will warrant and forever defend by these presents and it is furthermore the true intent and meaning of this Indenture and clearly understood by the parties thereto that in case the sd Elijah Reeves or those claiming under him shall at any time be evicted from the premises herein described and conveyed or any part thereof by any claim whatever that the person or persons so evicted are to have no recourse of any description whatever to the sd Benjn Reeves & Jenny his wife or either of them or either of their heirs executors or administrators for any remunition or compensation of any kind the granters releasing their title for a reduced consideration and the said Elijah relying solely upon the title thus conveyed without expectation of any possible recourse upon the grantors as aforesaid In testimony whereof the sd Benjamin Reeves & Jenny his wife have hereunto set their hands & seals this date first above written

I Alexr S Lyle Deputy for Joshua Stockton Clerk of the County Court for said County do certify that this Indenture of Bargain and sale from Benjamin Reeves & Jenny his wife to Elijah Reeves was this day produced before me proved by the oath of Elisha Hurd and Peter Cline two of the subscribing witnesses thereto and is together with this certificate duly recorded in said office Given under my hand the 11th day of July 1816
