Transcript

This Indenture made this fourth day of October in the year of our Lord one thousand eight hundred and thirty two between Samuel T Reeves of Ross county in the State of Ohio of the one part and Nancy Reeves of the same county and State of the second part Witnesseth whereas a controversy exists between the said parties in reference to the estate of Nathan Reeves the father of the said Samuel T Reeves and late husband of the said Nancy Reeves in consequence of which certain suits have been commenced between said parties in the court of Common Pleas of said county. And whereas said parties have agreed to compromise their said controversy and by which compromise the said Samuel T Reeves for the consideration of eighteen hundred dollars is to relinquish to the said Nancy Reeves any and every right or claim real supposed or imaginary which he has might or could have to any part of said Nathan Reeves's estate and at the same time relinquish and convey to her the said Nancy Reeves her heirs and assigns any and all estate right claim interest or title which he has asserts or could have or assert to the tract of land of which he has at this time the possession that is to say three hundred and fifty acres more or less situate in the county and State aforesaid and being part of Richard C Andersons survey N24 60 on which said part there an situate a certain mill & distillery besides other houses and improvements all of which including all the milling and distilling appratus machinery tubs or with the possession and to be relinquished and surrendered by the said Samuel T Reeves to the said Nancy Reeves by the terms of the said compromise and for the consideration aforesaid. Now therefore this Indenture made as aforesaid and in which Honora Reeves wife of the said Samuel T Reeves unites Witnesseth that the said Samuel T Reeves for and in consideration of the sum of eighteen hundred dollars lawful money of the United States to him in hand paid by the said Nancy Reeves at the time of sealing these presents the receipt of which is hereby acknowledged has fully and entirely relinquished released and quit claimed and by these presents do fully and entirely relinquish release and quit claim to her the said Nancy Reeves her heirs and assigns any all and any right interest title demand or claim real supposed or imaginary which he has might or would have to the whole or to any part of the estate property or money left by the said Nathan Reeves father of said Samuel T Reeves and more particularly for the consideration aforesaid the said Samuel T Reeves and Honora Reeves his wife have released relinquished and conveyed and by these presents do release relinquish and convey to her the said Nancy Reeves her heirs and assigns any and all right title claim interest estate or demand which he the said Samuel T Reeves and Honora Reeves his wife have or could have no matter in what capacity but especially all interest claim and demand of him the said Samuel T Reeves as child or heir or as dower purchase of said Nathan Reeves of in and unto the tract or parcel of land aforesaid that is to say three hundred and fifty acres more or less situate in the county of Ross aforesaid and being part of Richard C Andersons survey No 2460 together with the small distillery with all milling and distilling appratus machinery tubs &c and all other improvements and appurtenances whatsoever to the premises belonging and also all the estate right title or interest of them the said Samuel T Reeves and Honora Reeves his wife as either of them of in and to the said land premises and improvements being the same part of said survey of which said Samuel T Reeves has possession and for which he recently commenced a suit in chancery in the court aforesaid against said Nancy Reeves. And the said Samuel T Reeves hereby covenants to and with the said Nancy Reeves that he will surrender and yield to her the possession of all the lad and premises aforesaid including his present dwelling house by or before the fifteenth day of the present month (October 1832) ?? the mill and distillery the possession of which he the said Samuel T Reeves hereby covenants to yield up to the said Nancy Reeves on or before the first day of January next. To have and to hold the premises and improvements aforesaid with any of the appurtenances and also any and all the said Samuel T Reeves right or interest in the estate or property of said Nathan Reeves to her the said Nancy Reeves his heirs and assigns forever so that neither he the said Samuel T Reeves nor any person claiming by through or under him shall at any time hereafter have any manner of right of in or unto any part of the estate or land aforesaid. In Testimony whereof the said Samuel T Reeves and Honora Reeves his wife have hereto set their hands and seals the day and year first in these presents written

State of Ohio Ross County
I Peter Patterson a Justice of the peace in ad for said county do hereby certify that Samuel T Reeves the above named granter personally well known to me to be the identical grantor whom in the foregoing deed he represents himself to be did this fourth day o October AD 1832 personally appear before me and acknowledged the said deed and the signing and sealing and delivery of the same to be his own proper act and deed for the uses and purposes in the same expressed. Witness my hand and seal the 4th October 1832 also at the same time came Honora Reeves wife of the said Samuel T Reeves and se being above the age of eighteen years and personally known to me as the identical party whom she is in said deed represented to be was examined by me separate and apart from her said husband touching the contents of the foregoing deed which I fully made known to her whereupon she declares that she did voluntarily sign seal and acknowledge said deed as her own proper act and deed for the uses and purposes in the same expressed and that she is still satisfied therewith. Witness my hand and seal the fifth day of October AD 1832
