Transcript

In the name of God Amen. I Ezekiel Reeves of the County of Washington and State of Alabama being of sound mind and memory praise be God for the same, but knowing the uncertainty of this mortal life do declare this to be my last Will and Testament in manner and form following. In the first place all my just debts and funeral expenses are to be paid by my executor. In the second place I give devise and bequeath unto Anna B Rains the following described tracts of land one tract of land lying and being in the County of Clark in the State aforesaid on the east side of the Tombrebee River being the south west quarter of fractional section two Township Three Range one East containing one hundred and thirty four acres for which land I have named a patent from the United States of America Also one other tract viz the east fractional quarter of section numer two Township number three Range number one East containing one hundred and fifty more or less for which I have received the regular receipts for the payment of the same at St. Stephens Alabama dated the 3rd day of August 1835 lying in the County of Clarke State aforesaid also another tract viz the North half of the north east fraction and east half of the north west quarter of section numver thirty township number three Range number one east containing one hundred and fifty eight and a half acres which said land last described I have paid and received the Registered receipt dated 27th March 1836 Also the following negroes and their increase Peter a negro man Phillis a girl and her son Taney a girl by the name of Vines and her children viz William Hylliard Elijah Thomas and Alfred. Together with all my stock of horses horned cattle sheep hogs and kitchen furniture debts due and demand & may die seized and possessed of in right of in (?) all which property mendentally devised and Bequeathed and all other property not herein mentioned or any that I may acquire I do here give to Anna B Rain and the heirs of her Body forever bequitin not to be sold or disposed in any manner shape or form but to remain hers or her heirs forever I hereby nominate constitute and appoint my worthy and trust friend Joseph Johnston and Daniel Rain Trustees and execturos of this my Last Will and Testament hereby revoking all other wills heretofore made by me In testimmony thereif I have set my hand and seal seventh August in the year of our Lord one thousand Eight hundred and thirdy-six (1836) this will written on one sheet of paper and containing three pages - Signed Sealed and published by the above named Ezekiel Reeves as and for his last Will and Testament in the presence of us - who at his requests and in his presence have subscribed our names as witnesses thereto the word Waashington erased and the word Clerk ....

Washington County } 1842 personally came into open Court George W Johnston one of the subscribing witnesses to the instrument of writing who being duly sworn upon oath saith that he was present when Ezekiel Reeves signed the same and that he declared it to be his last Will and Testament and this deponent also saith that the other subscribing witness were present and requested to witness with himself the instrument and that said Reeves was in his proper senses
