Transcription

This Indenture made and entered into this 8th day of April A.D. 1845 between James A. Reaves, John Reaves, Martha Jane Loyd, Benjamin A. Reaves, Sarah C. Reaves, and Edward W. Reaves, the children and heirs of William and Elleanor Reaves deceased by Richard S. Forde Commissioner of the one part and William Foster of the other part Witnesseth that whereas Richard S. Forde Commissioner, appointed by the Judge of the Allen Circuit Court at the October term of said Court, did by virtue of a decree of said Court return at the aforesaid term, after having first duly advertised, agreeable to the directions of said decree, sold to the highest bidder the two tracts of land mentioned in said decree, to wit, one containing 121 acres, the other containing 131 acres more or less, and William Foster because the purchaser of both tracts, to wit, the one lying on big Trammel Creek at the sum of three hundred and twenty six dollars, and the one lying on Garrets Creek at the sum of Twenty six dollars, and executed his notes for said purchase money agreeable to said decree to the aforesaid heirs of William and Elleanor Reaves. Now therefore in consideration of the premises herein the heirs aforesaid Towit, James A., John, Benjamin A., Sarah C., Edward W. and Martha Jane Loyd, do grant bargain and sell unto the aforesaid William Foster, by Richard L. Forde Commissioner as aforesaid the two following tracts of land Towit, one lying on big Tramel Creek supposed to contain one hundred and thirty one acres more or less in the County of Allen and bounded as follows Towit, Begining at a Sycamore Corner of Robert McClary on the west side of the Creek, near the mouth of the big spring, thence runing up with the meanders of the dry creek to Charles Simmon’s line, thence with said line west to the corner, thence a North direction on a Military line of Jacob Millers to two dogwoods and Mulberry, thence a west direction on a line of a headright claim of said Millers to a state, thence a North direction to the first Northwest line of said survey to a Stake thence an East direction to said Robert McClarys corner a gum and beech, thence with a conditional line between Robert McClary and Jacob Miler an east direction 76 poles to the begining, the other tract hereby conveyed by the heirs aforesaid to the said Foster Contains 120 or 21 acres be the same more or less, lying and being in the County of Allen and State of Kentucky on Garrets Creek, and is bounded as follows (Towit) Begining in a sugartree and poplar on the Stateline, Samuel Hardy’s begining corner N20 W to a Conditional Corner a white oak tree, thence eastwardly in a conditional line made by Vardeman Smith and John Mynes to two red oaks, Standing on the bank of said Creek, thence down said creek with its meanders to a State, thence S63E 123 poles to two horn beams thence S13 E28 poles to a birch, thence S32 E 54 poles to a buckeye, white oak and beech, thence S70 W128 poles to the begining, together with all and Singular the appurtenances belonging to or in anywise appertaining to the aforesaid tracts of land unto him the said Foster his heirs and assigns forever, and they warrant and defend the right and title of their said ancestors against the claim or claims of themselves their heirs etc., and against the claim or claims of all and every person or persons whatsoever, holding or claiming by under or through, their said Ancestors or either of them.
In Witness whereof the said heirs of the said William A. and Elleanor Reaves by R. S. Forde Commissioner, do hereunto set our hands and affix our seals this day and date above written.

                  Circuit Court April term 1845
I James C. Mulligan Clerk of the Allen Circuit Court in the State of Kentucky Certify, that the within deed from James A. Reaves, John Reaves, Martha Jane Loyd, Benjamin A. Reaves, Sarah C. Reaves and Edmund W. Reaves by Richard S. Forde Commissioner to William Foster was produced in open Court on the 9th day of April 1845, and acknowledged by the said Richard S. Forde for and on behalf of the said grantors, to be his act and deed for the purposes therein mentioned, which was ordered to be Certified to the Clerk of the Allen County Court for Record, Given under my hand this 9th day of April 1845                   J. I Lemuel Swearingen Clerk of the County Court for said County, Certify, that this deed from the heirs of William and Elleanor Reaves Deceased by R. S. Forde Commissioner with the foregoing Certificate of J. C. Mulligan Clerk of the Allen Circuit Court therein enclosed, was this day produced to me in my office and I have recorded the said deed and Certificate and this Certification in my office as the Law requires. Given under my hand this 9th day of April 1845
