Transcript

This Indenture made the twenty fourth day of December in the year of our Lord one thousand eight hundred & forty seven Between John Reeves of the township of Liberty in the State of Ohio and Margaret his wife of the one part and Joseph Reeves Sarah Ann Hellman late Reeves Elizabeth C Matlack late Reeves George F Reeves Mary Ann Rue late Reeves and Elanora Story late Reeves of the other part witnesseth that whereas John Reeves late of the township of Northampton in the County of Burlington and State of New Jersey by divers good conveyances and assurances in the law became seized in his demisne as of fee simple of and in several tract of land and premises situate in the said township of Liberty in the County of Butler in the State of Ohio and whereas the said John Reeves being so thereof seized died intestate and without having made any disposition thereof whereupon the same descended to and became the right and inheritance of his children and heirs at law to wit John Reeves Joseph Reeves Sarah Ann Reeves who hath intermarried with William Helleman Elizabeth C Reeves who hath intermarried with Watson R Matlack George F Reeves Mary Ann Reeves who hath intermarried with John Rue Elanora Reeves who hath intermarried with Charles ___ and whereas the said children and heirs at law of him the said John Reeves deceased being desirous of making or bringing about a partition or division of the said real estate whereof the said John Reeves died seized of in fee simple as aforesaid and having by their attorney in fact Daniel Wills agreed upon a negotiation or a contract between the said children and heirs at law of him the said John Reeves deceased to wit John Reeves of the one part and Joseph Reeves Elizabeth C. Matlock late Reeves Sarah Ann Hellerman late Reeves George F Reeves Mary Ann Rue late Reeves and Elenora Story late Reeves. Not this Indenture witnesseth that the said John Reeves and Margarette his wife for and in consideration of the sum of one dollar to them in hand paid by the said Joseph Reeves Sarah Ann Hellerman Elizabeth C. Matlack George F. Reeves Mary Ann Rue and Elenora Story and for and in the further consideration of the said Joseph Reeves Sarah Ann Hellerman Elizabeth C. Matlack George F. Reeves Mary Ann Rue and Elenora Story his coheirs and tenants in common releasing the land tenements hereditaments and real estate whereof the said John Reeves died seized in fee simple in the county of Butler and State of Ohio and that immediately at and before the ensealing and delivery hereof the receipt & payment whereof is hereby acknowledged have granted bargained & sold aliened enfeoffed released and conveyed and confirmed and forever quit claimed and by these presents do absolutely grant bargain and sell alien enfeoff release convey and confirm and forever quit claim unto the said Joseph Reeves Sarah Ann Hellerman Elizabeth C. Matlack George F Reeves Mary Ann Rue and Elenora Story and to their heirs and assigns forever all that the equal undivided one seventh part of the lands tenements hereditaments and real estate whereof my Father the said John Reeves died seized of in the township of Northampton in the County of Burlington and State of New Jersey which said one seventh part thereof I the said John Reeves became seized of as one of the children and heirs at law of the said John Reeves deceased and which I hereby release and quit claim the same to his brothers and sisters for and in the consideration of their releasing to me the land in the township of Liberty in the county of Bulter and State of Ohio.
Together with all and singular the houses outhouses edifices & buildings thereon erected and being and all ways waters water courses woods fences gardens minerals mines rights liberties advantages hereditaments and appurtenances thereunto belonging or in any wise appertaining and the reversions and remainders rents issues and profits thereof and also all the estate right title interest use trust property possession claim and demand whatsoever of them the said John Reeves and Margarett his wife or either of them therein or thereto. To have and to hold the said equal undivided ine seventh part of the said land and premises hereby granted and released or mentioned or intended so to be with the appurtenances unto the said Joseph Reeves Sarah Ann Hellerman Elizabeth C. Matlack George F Reeves Mary Ann Rue and Elenora Story their heirs and assigns to the only proper use benefit and behoof of the said Joseph Reeves Sarah Ann Hellerman Elizabeth C Matlack George F Reeves Mary Ann Rue and Elenora Story their heirs and assigns forever and the said John Reeves for himself his heirs executors and administrators doth covenant and agree to and with the said Joseph Reeves Sarah Ann Hellerman Elizabeth C Matlack George F Reeves Mary Ann Rue and Elenora tory their heirs and assigns by these presents that he the said John Reeves and his heirs the said one seventh part of the said land and premises hereby granted and released or mentioned or intended so to be with the appurtenances unto the said Joseph Reeves Sarah Ann Hellerman Elizabeth C Matlack George F Reeves Mary Ann Rue & Elenora Story their heirs and assigns against him the said John Reeves and his heirs and against all and every other person whomsoever lawfully claiming or to claim by from or under him or his heirs or any or either of them shall and will warrant and forever defend by these presents. In witness whereof the said John Reeves and Margarett his wife parties of the first part tothere presents have hereunto set their hands and seals dated the day & year first above written.
