Transcript

This is the last Will and Testament of me Abraham Reeve of Walham Holy Cross in the County of Essex Gentleman I nominate constitute and appoint my son Joseph Walter Reeve and my daughter Elizabeth Ann Reeve trustees and executors of this my will and I give and devise unto them their executors and administrators and to the survivor of them any real estate of which I may die possessed upon trust that they or the survivor of them or the executors or administrators of such survivor do and shall sell and dispose thereof for the most money that can be obtained for the same and as soon as conveniently can be after my decease and I hereby declare that the receipt of my trustees under their hands shall be a full discharge to any purchaser and shall effectually exonerate him from all responsibility as to the application of such purchase money and as to the money to arise from such sale I direct that the same should ? into and form a part of my personal estate and I give and bequeath unto my daughter Elizabeth Ann Reeve all my household furniture plate? china and other household effects of every description save and except my pony and pony chair and harness and several other things hereinafter mentioned to my sons for her own absolute use and benefit and I hereby give and bequeath unto my said executors and trustees all my rest and personal estate whatsoever and wheresoever except my household furniture upon trust that they do and shall place out and direct the same at interest and after payment thereout of my funeral and testamentary expenses and all my just debts then during the life of my dear wife to support and maintain and clothe her and also my said son Arthur Reeve during his apprenticeship to supply him with all that may be needful for any instruments or other expences that may be unavoidably incurred with respect to him from the interest thereof if that shall prove sufficient and if not to be at liberty from time to time to advance such portion of the principal as may be needful to make up such deficiency and whereas my son William Reeve was sometime since indebted to me in the sum of six hundred pounds and upwards on a warrant of attorney and sometime since paid me the sum of two hundred and twenty five pounds part thereof thereby reducing the same to four hundred pounds and on that occasion I thereby do agree and did accordingly give up to him the further sum of two hundred pounds thereby reducing the debt due from him on such warrant of attorney to the present amount ? two hundred pounds odd and inasmuch as the sum of two hundred pounds ? up to him as aforesaid together with the sum of twenty pounds ? I hereby give and bequeath to him and authorize him to retain out of the money so remaining due from him to use after my decease as a legacy for ? and I give and bequeath to my said executors and trustees my said pony chairs and harness upon trust to sell the same when and as they shall think fit and the money to arise thereof to form part of my personal estate I give and bequeath unto my daughter Elizabeth Ann the sum of one hundred pounds sterling to be paid to her out of the monies now standing in the public funds in the names of my said trustees and I give and bequeath unto my son Arthur the sum of one hundred and thirty pounds for his absolute use and benefit to be paid to him out of the aforesaid money in the public funds and of that to arise from the sale of the said freehold estate also I give and bequeath to him my said son Arthur my silver watch and gold chain if found being at present lost also I give and bequeath unto my said son Arthur my Bridle with ? also I give and bequeath unto my son Joseph Walter the residue of the money now standing in the public fund and of the money ? and be procured by the sale of the said freehold estate and I hereby declare my will and meaning to be that in case the residue of such last mentioned monies shall fall short of the sum of seventy pounds that then my said daughter and my said son Arthur shall abate out of the legacies so as aforesaid given to them so much each in proportion as will raise their said brother Joseph Walter's legacy to the full sum of seventy pounds and I hereby direct that the payment of the several legacies hereinbefore and hereinafter bequeathed to my said daughter Elizabeth Ann and to my said sons Arthur and Joseph Walter shall be paid to them severally as soon as conveniently may be after the decease of my said wife provided my said son Arthur then have attained the age of twenty one years and I give and bequeath unto my son Joseph Walter and Arthur and to my daughter Elizabeth Ann the sum of two hundred and ten pounds ? the amount owe to me from my said son William to be equally divided between and amongst them and share alike to and for their own absolute use and ? it out my wish and desire is that they be lenient and partial in pressing for the payment thereof in case my son William shall at the time be in needy circumstances and I hereby declare that my said executors and trustees shall be at liberty to ?ourt and retain to themselves all expenses that they may sustain or be put unto in the execution of this my will and that they or either of them shall not be bound to make good any loss or losses that may occur therein provided they shall not occur through their own wilfull default or neglect In witness whereof I the said Abraham Reeve the testator have to this my last will and testament contained in two sheets of paper have set my hand and seal this ninth day of January 1851
