Transcription

This Indenture Witnesseth that John J Johnston & Mary Johnston his wife of the County of Fayette & State of Indiana in Consideration of five hundred dollars to them paid by Elijah Reeves of Hancock County & state aforesaid the receipt whereof is hereby acknowledged do hereby grant bargain sell and Convey to the Said Elijah Reeves his heirs and assigns forever the following Real Estate in Hancock County and State of Indiana and described as follows towit the South West quarter of the North West quarter and North West quarter of South West quarter of section number Thirty two in Township number seventeen North of Range number eight East of the lands directed to be sold at Indianapolis containing Eighty acres more or less together with all the privileges and appurtenances to the same belonging. To have and to hold the same to the said Elijah Reeves his heirs and assigns forever. The grantors their heirs and assigns hereby covenanting with the grantee his heirs and assigns that the title so conveyed is clear free and unincumbered that they are lawfully seized of the premises aforesaid as of a sure perfect and indefeasible estate of inheritance in fee simple and that they will warrant and defend the same against all claims whatsoever.
In Witness whereof the said John J Johnston and Mary Johnston his wife who hereby relinquishes her dower in said premises have hereunto set their hands and seals this fourteenth day of December 1852.

State of Indiana Fayette County. Personally appeared before me the subscriber a Justice of the Peace in and for said County John J Johnston the grantor in the above Conveyance and acknowledged the same to be his voluntary act and deed. And the said Mary Johnston wife of the said John J Johnston being examined by me privately separate and apart from and without the hearing of her said husband and the full contents and purport of said deed being by me made Known and explained to her acknowledged that she executed the same of her own free will and accord and without any coercion or compulsion from her husband.

I Amos R Edwards Clerk of the Fayette Circuit Court do hereby certify that James C Rea Exqr before whom the annexed instrument appears to have been acknowledged was at the time of taking such acknowledgment an acting Justice of the Peace in and for said County and duly authorized by law to take the same and am acquainted with his signature and believe the annexed signature purporting to be his to be genuine. Witness my hand and the seal of said Court at Connersville this 15th day of Dec 1852.
