Transcription

In the name of God Amen. I Peter Reves of the County of Halifax and State of Virginia being of sound mind and disposing memory do make and constitute this my last will and testament Viz. I desire that all my just debts shall be paid if not otherwise by selling Martha a negro woman after which I desire that all of my slaves be divided in three divisions as nearly equal as can be by Valuation and I desire and will that my beloved wife Shall have privilege of choosing which of the lots so divided she will have which I lend to her during her life or widowhood. I also loan to her two good beds and Furniture one Press and three Trunks one Holding Table and side chairs my Barouch and Horse called Pony two cows and Calves two Pots and Hooks one Dutch oven & lid one sow and Pigs and six Sheep and I also loan to my wife the tract of land on which I now live during her life or widowhood

I hereby confirm what I have given to my son Peter M Reves Viz. about forty Acres of land lying in the fork of Runaway Creeks and a negro woman named Caroline and one hundred dollars in money and I also give unto my son Peter M Reves the second choice of lots of slaves as divided above and also my Blacksmith Tools upon condition that he will do all of his step mothers Shop work

And I give and bequeath the third and last lot of slaves as divided above as follows To my Daughter Nancy D. Ferrell one third of said lot of slaves To my grand Daughter Elizabeth P. Chaney one third of said lot of slaves and to the surviving children of my son William T Reves Decd one third of the remaining lot of slaves as as (sic) divided first above. At the marriage or decease of my wife I give and bequeath to my son Peter M Reves all the Slaves and other property except the land which I have loaned to my wife and I give & bequeath after the marriage or death of my wife my tract of land to be equally divided between the three sons of my son Peter M. Rives (sic Reves) The Remaining portion of my Estate including my lot and shop at Republican grove I desire to be sold by my executor herein after named and applied to the payment of my Just debts

I do hereby appoint and ordain my son Peter M Reves Executor of this my last will and testament hereby revoking all other in testimony whereof I have hereunto set my hand and seal this the eleventh day of December eighteen hundred and fifty four.

Whereas I Peter Rives (six Reves) of the County of Halifax and state of Virginia have made & duly executed my last will and testament in writing bearing date the eleventh day of December eighteen hundred and fifty four Now I do hereby declare this present writing to be a codicil to my said will and direct the Same to be annexed thereto and taken as part thereof and I do hereby revoke so much of said will as relates to the disposing of the third and last lot of slaves as divided in said will and also that portion of said will which relates to the disposal of my tract of land on which I now live Viz. I give and bequeath said lot of slaves to my son Peter M Rives (sic Reves) upon condition that he pay to my grand children the heirs of my son William T. Rives (sic Reves) Decd each fifteen dollars and to my Grand Daughter Elizabeth P. Chaney Daughter of William C. Ferrell one hundred Dollars and to my Daughter Ann D. Ferrell Ten dollars in Gold I give and bequeath to my son Peter M Reves my tract of land on which I now live subject to my wife’s Dower. In witness whereof to this present writing which I hereby declare to be a codicil to my last will and testament bearing date the eleventh day of December in the year eighteen hundred and fifty four and which I direct to be added thereto and to be taken as a part thereof I have set my hand and seal this thirteenth day of January eighteen hundred and fifty five. At a court held for the County of Halifax the 27th day of April 1857
                  The within written last will and testament of Peter Rives (sic Reves) Deceased with a codicil thereto annexed was presented in court and proved by the oaths of two witnesses thereto subscribed & ordered to be recorded. And on the motion of Peter M. Rives (sic Reves) who made oath thereto according to law and with John Milner and Robert Jennings his securities entered into and acknowledged a bond in the penalty of $15,000.00 conditioned according to law certificate is granted him for obtaining probate of the said will in due form The securities having Verrified their sufficiency on oath
