In the name of God Amen I Richard Rives of Borough of Shaston in the Countie of Dorsett Gentleman being now in perfect and sound health and understanding for which I render all humble and heartie thanks unto my heavenly father doe this eight day of August in the nynth yeare of the reigne of our Soveraigne Lord Charles by the grace of god king of England &c Annoq Dm one thousand six hundred thirtie three make and ordeyne this my last Wil and testament in manner and forme following vizt
First I give and bequeath my soule into the hands of allmighty God who first breathed it into mee in full assurance of the free pardon and remission of all my sinnes in and through the all sufficient sacrifice and satisfaccon of my blessed Lord and onely Savyour Christ Jesus who hath dyed for mee that through faith I might live in him with full assurance that I shall rise againe att the last day one of gods chosen and elect which God do ? for the same Jesus Christ his sake. Amen. And my bodie I leave to bee buried at the peasure of my executor and overseers hereafter named saying with the holy prophett The Earth is the Lords & all that therein is that ye temporall estate wherewith it hath pleased God to blesse mee may peaceably and without emulacon bee emjoyed by those whose shall succeede mee in the use thereof which I heartily desire I doe hereby give and devise unto and for the reparacons of the bodie of the parish church of St Peters within the Burrough of Shaston in the Countie of Dorsett fortie shillings Also I give more unto the poore people of Shaston aforesaid five pounds the same to bee distributed att my funerall if I shall bee buried in Shaston. If otherwise then as soone as it may conveniently bee done after my funerall And I give unto the preacher who shall preach att my funerall twentie shillings all my lands and tenements whereof or wherein I have any estate of inheritance and all my leases goods and Chattells as well reall as personall which I shall not hereby particularly bee otherwaies disposed of I leave give devise and bequeath unto Richard Rives my sonne and heir apparent whom also I doe hereby appoynt and ordeyne to bee the sole executor of this my last will and Testament. Also I doe hereby give and devise for mee and myne heires unto Dorothie Rives my now wife one Annuity or yearely some of money of fortie pounds to have and to hold the said annuitie unto my said wife for and during her naturall life and to bee paid att the fouer most usuall feasts or quarterly daies of payment in the yeare vizt the feast daies of St Michaell tharchangell the nativity of our Lord Christ thanunciacion of the blessed Virgine Mary and the feast of St John Baptist by equall even parts and porcons And the place for payment or tender thereof to bee att or in the south porch of the parish church of the holy Trinity with in the Borough of Shaston aforesaid.
Item I give unto my said wife the bedsted and bed with all the furniture thereof and therewith used wherein shee doth now most usually lye with two payre of sheetes such as are usuall for her bed And I wil further that my sayd wife shall have some of my pewter brasse and houshold stuffe to the value of tenne pounds And my said wife to elect and chuse such and soe much thereof as shall not exceede the said value of tenne pounds provyded alwayes that these bequests and legacies unto my said wife as aforesaid shall bee in full satisfaccion and discharge of all such dower joynture advancemt or demands as the said Dorothie my wife might or ought to have or clayme of unto or out of any my reall or psonall estate by the lawe or by reason of any writings covenants or agreemts had or made before or since my intermarriage with the said DOrothie and if my said wife shall any waies sue or molest my heire or executor for any thing not hereby devised unto her then the said annuity and all other legacies hereby devised unto her shall cease and bee utterly voyd Also I give and devise unto my younger sonne John Rives the some of six hundred pounds of lawfull money of England to bee payd by my executor within one yeare after my death which said six hundred pounds I wil and devise that the overseers of this my will or the survivors of them shall employ or dispose of for the benefitt of my said sonne John Rives untill my said sonne John Rives shall fully accomplish the age of foure and twentie yeares And if it shall happen that my said sonne John Rives dye before his said age of fower and twenty yeares accomplished then my will is that the said legacy of six hundred pounds and the profitt or encrease thereof shall remayne retaine come and bee unto my eldest sonne Richard Rives But that my said sonne Richard Rives shall out of the said six hundred pounds pay unto each and every of my daughters the some of fifty pounds apeece which said daughter or daughters shall bee either maryed in my life tyme with my consent or which after my decease shall marry with the consent and approbacon of the greater number of the overseers of this my will or of the survivors of them and whoever of my said daughter shall marry without such consent my will is shee shall lose the benefitt of the legacie of fiftie pounds. And I due further give and devise unto my eldest daughter Anne Rives three hundred pounds And also unto my third daughter Dorothie Rives the like some of there hundred pounds more which said legacies unto my said daughters my will and desire is shall bee payd within six moneths after my decease and shall be imployed or disposed by the overseers of this my will for the benefitt of my said daughters untill my said daughters shall severally and respectively accomplish her and their full age of twentie & foure yeares or shall be marryed with the consent and appoyntment of the overseers of this my will or the survivor of them or the greater number of them and then and not otherwise to bee payd unto my said daughter and daughters And my will is that if any or either of my said daughters shall happen to dye beinge unmarried before shee or tey shall accomplish her said full age of foure and twenty yeares then the legacies or porcon aforesaid of her of them soe dyeing shall bee equally devyded betwixt my two sonnes Richard Rives and John Rives if they shall bee both liveing or if either of them dye then to bee payd to the survivor And my will meaneing is that if either of my said daughters shall happen to marry before shee shall accomplish her age of twentie and foure yeares without the consent & approvemt of my said overseers or the major part of them then liveing then I will and desire that such my daughters soe marrying shall have onely a legacie of twentie pounds And that shee shall forfeite and lose all other elgacies and benefitt which should or might in any sorte come unto her by this my last will which I hereby appoynt shall be equally devyded amongst the rest of my children then liveing And I will that from my decease untill my said legacies shall bee paid by my executor according to this my will my said executor shall pay and allow for and towards the mayntennance of my said younger sonne and daughters such somes of money and in such manner as the said overseers or the survivors of them or the greater nomber of them shall appoynt or thinke fitt. Also I give devise unto my brother Benjamyn Rives five pounds which heretofore I lent unto him for wch I have his bond and I will the said bond bee delivered up unto my brother Beniamyn to bee Canceled. Also I give and devise unto my brother Joseph Rives fiftie pounds wch about fourteene yeeres since I lent unto him to bee employed with him in trade.
Item I give and release unto my brother Brune Rives all such somes of money as I have heretofore lent unto him All the residue of my estate reall and personall money goods and chattells I give and devise unto my said executor and ledest sonne Richard Rives and my will is that if my sonne Richard Rives shall happen to dye before hee shall come out of his apprentishipp or shall accomplish his full age of twentie and foure yeares shall have or leave behind him at the tyme of his death nor issue of his bodie lawfully begotten nor any lawfull wife then my will is that my said sonne John Rives shall succeede his said brother by inheriting his said lands and shall also succeede his said brother in the executorship of this my last will and testament and shall have and enjoy all such and like benefitt as my said sonne Richard should or might have had by this my said last will if hee had lived. And I will and desire that my said overseers dureing the apprenticeship of my said eldest sonne and untill hee shall accomplish his said full age of twentie and foure yeares shall receive & employ the rents and profitts of all my said lands leases and money for the benefitt of my said eldest sonne and to see my said wife paid her annuitie according to this my will out of the same unlesse my said overseere shall see cause or thinke fitt to let my said sonne Richard have some part thereof to imploy in his said trade of mchandising. And I doe hereby entreate my welbeloved friends Willmus Hitaker of Shaston aforesaid Esquire my cosen George Rives of Randelston my cosen John Fussell of Blandford and my brother Bruen Rives of London to bee the overseers of this my last will & Testament and to afford their best assistance to see this my last will to bee truely performed in all poynts And I give unto every of my said overseers fortie shillings apeece to bee bestowed in a ring for each of them severally and respectively amounting in the whole unto eight pounds which I will my said executor to deliver accordingly And I will that when ever my said overseers any or either of them shall meete or shall travayle or bee putt unto any expence or charges for in or about the performance or execucon of this my will in any thing then his and their charges or expences to bee borne defrayed and payd by my said executor In wittnes whereof I have hereunto sett my hand and seale and published these three sheetes of paper folded together to bee my last will & testament in the presence of Richard Rives Willm Whitaker Edw Smith Thomas Morgan Nicholas Couper

A Codicil
Whereas I made my last will and testament the eight daie of August in the yeare of our Lord God one thousand six hundred thirtie three And in the nynth yeare of our Soveraigne Lord King Charles By which I disposed the temporall estate that it hath pleased God to lend mee now my will and pleasure is to alter some things therein that is where I gave my now wife Dorothie Rives a Annuitie or yearelie some of money of fortie pounds to bee paid quarterlie as by the said will doth expresse now my said will and pleasure is that shee shall have but thirtie pounds yearely to bee paid at the place and tyme that the said will doth expresse dureing her naturall life and whereas I have given by the same will unto my eldest daughter Anne Rives the some of three hundred pounds now my will and pleasure is that shee the said daughter Anne Rives shall have twentie pounds yearelie paid her quarterly as my said wife is to have payd at the same tyme and at ye same place by equall and even parts and porcon and not to have the three hundred pounds or any part thereof.
