Memorandum that Sr William Rives kt late of the Cittie of Dublin deceased the tenth day of this instant March Anno Domini ?ilo Anglia One thousand sixe hundred fortie and seaven being of perfect mind and memorie made and Declared his last will and testament nuncupative in manner and forme or in effect as followeth (vizt) Gentleman and Gentlewomen (he speaking to those that were then prent with him in the Chamber where he lay sicke) I have bin all this day busie in settling of my estate and should have made my will, which in regard I have tried my selfe I intend to doe it to morrow but feareing my sickness should prvent mee and findeing my selfe verie weake I doe desire yow gentlemen and women and all you my friends that stand by to take notice that I doe now will and bequeath unto my deare and loveing wife Dame Dorothie Rives All my goods household stuffe debts and Chattles whatsoever And doe make her sole executrix of this my nuncupative will. Shortlie after the uttering of the aforesayd words Mrs Verscoyle who was then present being about to take her leave and goe away hee showeing the Intire affection which he did beare unto his sayd Ladie uttered these words I pray you Mrs Verscoyle stay a little longer and fore yor better remembrance I will speake the words againe that you may remember them which had accordinglie sayeinge I give all my goods chattles and debts unto my sayd wife And I doe nominate her sole executrix of this my will and therewith prsently gave in charge to his sonne Charles Rives who was then standing by to carye the sayd will nuncupative formerlie by him expressed and Declared to be put in writing and to be carried unto the witnesses then present the next day that they might thereto put theire severall hands as witnesses to the intent they might not forget what his will was and he then also declared that the reason why he did soe was for feare he should not be able to perfect his will in writing the next Day & there being prsent at the uttering of the aforesayd will the next Day Charles Rives sonne to the sayd Sr William haveing formerlie recorded structions from his father to reduce his mynd into writeing prsented his will written and read it to his sayd father who approved thereof the tenor whereof ensued In the Name of God Amen I Sr William Rives of the Cittie of Dublin kt being of perfect understanding and disposeing memorie but sicke in bodie doe make this my last willl and testament in manner and forme following vizt Inpr I commend my soule into the hands of God who gave it and his sonne Jesus Christ my only Lord and Saviour by the merit of whose death and suffering I epxect remission of my sinnes and noe other meanes whatsoever and my bodie to be buried in St Johns Church as neere unto my deceased wife and daughter as with and convenient it may. Item I make my deare wife Dame Dorothie Rives sole executrix of this my last will and testament to whome I give and bequeath all my goods howsehold stuffe debts ? and other Chattles whatsoever excepting such debts and leases as are hereafter mencodd vit my lease or leases of such estate as I have in the Countie of Downe which I here bid give and bequeath unto my welbeloved sonne John Ryves Ad also my lease or leases or other estate whatsoever which I ahve in ye Rectorie of Nave which I hereby give and bequeath unto my welbeloved sonne Charles Rives whom I doe hereby appoint my executor of one bond and unto mee from the right honorable James Lord Marques of Ormand And one other Bond I? unto mee from James Earker? of Rescomon for the only use and behoofe of my welbeloved daughter Dame Elizabeth Leigh.This Will was proved at London the Nineteenth day of the moneth of Julie In the yeare of our Lord God one thousand sixe hundred fiftie and one before the worshipfull William Foorte Doctor of the Lawes Surrogate to the right worth Nathanael Brent? knight Doctor of the Lawes and Master or Keeper of the Prerogative Court by the oath of Dame Dorothy Rives the Relict and Charles Rives the sonne executors named in the last will and testament of the sayed Deceased to whome Administration of all and singular the goods chattles and debts of the sayd Deceased which anie manner of way Concerne the sayd will was grannted and Committed they being first legally sworne well and faithfullie to administer the same.
