In the Name of God Amen I Thomas Ryves of the parish of St. Andrew Holborne in the County of Middlesex Esqr in health of Body and sound disposing mind and memory thanks to Almighty God do make and declare this my last Will and Testament (vizt) principally I comend my soul to God my Creator in the humble assurance of the pardon of all my sins through Christ my Redeemer and to inherit life eternal and my Body I commit to the Earth to be interred in a decent manner and my funeral ordered according to the discretion of my executors and my temporal estate I dispose as followeth (to wit)
First I will that all my debts and funeral charges be thereout paid and satisfied.
Item I will that immediately after my decease an inventory be taken by my executors of all my Jewells plate and household goods and that my wife Elizabeth have the use of all such my jewels plate an household goods for and during so long time after my decease as she shall continue my widow and unmarried she giving Bond to my executors in sufficient penalty for the producing and delivering them to my executors in case she marrys again immediately then after to and for the use of such child or children I may then have living by her in equal shares and oblidge her executors or Administrators to deliver them at her death to my executors for the use of my children and in case she continues my Widow and unmarried to the time of her death I will and give her power under her hand by writing testified by two witnesses to dispose of such jewells plate and household goods to or among such my child or children in such manner proportion she shall think fit and for want of such disposition in that case I give and leave the same to such my child or children then living equally.
Item All the Rest and Residue of my Goods Chattles Reall and personall estate whatsoever I give leave and bequeath to and among such my child or children as shall be living at the time of my death to be divided and paid them by my executors in such proporcions as my wife shall order and direct if she be my widow and unmarried when they severally attain the respective aged of one and twenty years or day of marriage which first happens my intent being that my said wife if then my widow and unmarried shall have power hereby to limitt the Quantum of each childs porcon thereout at her discretion and in case my Wife happens to marry again after my decease then I will that the same be divided and paid to or among such my child or children by my executors in equal parts share and share alike as they come to such age or marriage And I will that in the mean time the interest or income of my said Residuary Estate be applyed for or toward the education and maintenance of my children by my executors And I nominate and appoint my beloved Brother George Ryves Esqr and my good friend Mr Anthony Brucer Joynt Execrs of this my Will and I make them and my wife Elizabeth joynt Testamentary Guardians to my Children and if any dispute arise in Relation to the Guardianship I will that any two fo them shall determine it And I revoke all former wills or testaments by me in any wise made or declared and declare this only to be my last Will and Testament in Witness whereof I have hereunto set my hand and affixed my seal the nine and twentieth day of September in the year of our Lord God one thousand seven hundred and twenty two.

Appeared personally George Ryves of Ranston in the County of Dorset Esqr and Anthony Brucer of the parish of St Gyles in the fields in the County of Middlesex Esqr and by virtue of their Corporal oaths swear and depose that Thomas Ryves late of the parish of St Andrews Holborne in the County of Middlesex but at Bombay in the East Indies Esqr deced did on or about the nine and twentieth day of September in the year of our Lord 1722 make his will in writing hereunto annexed beginning thus In the Name of God Amen I Thomas Ryves and ending thus in the year of our Lord one thousand seven hundred and twenty two and thereof made these depts his executors and Guardians to his Children and these deponents further depose that they have been informed and believe that the said deced since the making of the abovementioned will did at Bombay aforesaid make a Coicil by which he did ratifie and confirm his said Will made in England and impowered some persons there to transmitt his effects in India to these Deponents to the uses of his said Will and that the said Codicil has been proved in the proper Office there And those depots further depose that the Estate of the said Deced suffers very much for want of these Depots having probate of the said Will under Seal of this Court whereby they would be impowered to receive the sum of two thousand five hundred pounds which now lyes ready towards the dischargeing a large sum of money which the deced took up upon Bottom Rea and which now lyes by way of Respondencia at the Rate of about 15 per cent per annum and will so continue till paid of and discharged and these depts declare that they will bring into the Registry of this Court the said Original Codicil or an authentick copy thereof as soon as they can after the arrival of the ship the Prince Augustus whereof the said Deced was late Comander
