Transcription

To all whom these Presents may concern Whereas James Somerville of the Town of Fredericksburgh attorney in Fact for John Mitchell Lenox Scott and Company hath in the Name of the said Company brought a suit against Thomas Reeves of the County of Augusta to recover the sum of fifty three Pounds eighteen Shillings and one Penny with Interest from 10th December 1766 which sum the said Thomas Reeves hereby confesses and acknowledges to be justly due and owing to the said Company, and whereas it is mutually agreed between the said Somerville and Reeves that in Consideration of the said Reeves’s consenting that John Herndon shall assign over to the said Somervill for the use of the said Company all the Interest that he hath or may claim in two negro slaves mortgaged to the said Herndon except the value of thirty two pounds a Ballance (sic) still due to the said Herndon and also in Consideration of the said Reeves assigning over all his Right and Interest of and in several sums of money and Sundry Negroes for which the said Reeves hath prosecuted several suits in the Court of Spotsylvania County he the said Somervill hath consented that the said Reeves shall be discharged out of the Sheriffs custody and that he will not take Execution on the said Judgment untill it appears that the said Negroes and Judgments be obtained by the said Reeves as aforesaid are not Sufficient to discharge the said Judgment, Now the said Thomas Reeves in Consideration of the Premises, doth hereby consent that the said John Herndon shall and doth also impower the said John Herndon to assign over all the Interest that he hath in the mortgaged negroes aforesaid except the value of Thirty two Pounds now due to the said Herndon and the said Thomas Reeves doth further in Consideration of the Premisses hereby assign over to the said Somervill for the use of the said company, all his Right Title and Interest of in and to the said monies and Negroes sued for by the said Reeves as aforesaid, The said Reeves doth also in consideration of the Premises covenant and agree that the said Somervill shall and may sue out Execution on the said Judgment as soon as it shall appear that the negroes and monies aforesaid are not Sufficient to discharge the same and that he the said Reeves will pay and discharge this expense of this writing, In Witness whereof the said Thomas Reeves hath hereunto set his hand and affixed his seal the Eighth day of June in the year one thousand seven hundred and sixty nine –

This Agreement between Thomas Reeves and James Somerville for Mitchell, Lenox, Scott and Company was proved by the oath of Charles Bruce a witness thereto and ordered to be Recorded ~
