In the name of God Amen. I John M. Seybolt of the Mamacatten Town, County of Ulster and State of New York, yeoman, being weak in body, but of sound mind memory and understanding, blessed be Almighty God for the same do make and publish this my last Will and Testament, in manner and form following, that is to sayFirst I most humbly bequeath my soul into the hand of God my maker, when he shall be pleased to call me, hopeing and resting in his mercy thro Jesus Christ Amen, blessed be God, I give my body to the earth from whence it was taken, in full assurance of its resurrection at the last day
As to my worldly estate I will and possitively order that all my just debts be paid
First I give to my dear and living wife Mary Seybolt for the term of her life remaining my widow the room I now lodge in, in my now dwelling house, with as free and full use of any and every part of the same house, celler outhouses Barn, Stable, Gardens and orchard as she may stand in need of or that may be judged sufficient for her benefit and advantage in and to her own private use during the above term, and also for the term of her natural life, I give unto her, my said wife remaining a widow in my name, one fourth part of the produce raised upon my farm, of Grain Hay, and vegitables of every kind yearly raised on any and every part of my estate Freehold or improvements, and yearly and seasonably delivered to my said wife or deposited on any part of sd Farm. She shall order and direct and my will and meaning also, is that my two sons hereinafter named do yearly and every year dutifully so render as above unto their tender indulgent mother by them their heirs executors administrators or assigns out of my estate for the above term, of their mothers natural life and her being my widow, I give my said wife all my household furniture of every kind to her own disposal forever. I also give to my said wife tow cows her first choise out of my stock, and pasture in the fields, on my farm, for them, and six sheep, instead pasture season, I give her also six sheep her first choise out of the flock and hay for the above two cows, and six sheep and not? of the fourth of the hay but the fourth of all other produce as above,
Item I give unto my eldest son John Seybolt the remainding use of the house out houses Barn, and stables, where I now live, during the life of his mother as above and after her decease or other determination as above, then to remain to him and to his heirs and assigns forever, I give unto my sd son John Seybolt the one half of all my lands and improvements situate in sd town to him and to his heirs and assigns forever.
Item I give unto my son Frederick Seybolt the other moiety or one half of all my lands and improvements situate as above with the whole of the building where my son Frederick now lives during the Tenure of sd improvement where he resides But the one half of the lands of my Freehold estate I give unto him and to his heirs and assigns forever.
Item I give unto my daughter Fanny Vail twenty pounds, I give unto my daughter Rebekah Mullock twenty pounds, I give unto my daughter Phebe Reeves twenty pounds, I give unto my daughter Catharine Seybolt twenty pounds. I give unto my Granddaughter Fanny Reeves in lieu of her mother deceased, twenty pounds, the whole to be paid in money or cattle at an appraised price, the whole of these legacies to be paid by my executors after the following manner, one third part to each of the above legatees in the space of one year, and the whole to each of my daughters and Grand daughter, within the space of three years, after my decease in money or cattle, my will is, that my two sons John Seybolt and Frederick Seybolt do take to their own use and discretion the whole of my effects, and stock of cattle not bequeathed to their mother to assist and better enable them to pay the above legacies, which legacies they are duly to pay and them their heirs or assigns to pay and render the profits of the lands unto their mother as before willed above. And I will that the lands be divided between my two named sons in Quality and Quantity (excepting where I now live, my son John having laboured thereon his labour shall not be taken away But instead thereof and that strict justice may be done to both my sons, and that love and harmony may be and remain with them; whensoever my son Frederic may think proper to build, my son John shall aid assist and do (out of Johns own estate) to the help of his brother Frederick Building him an house and barn. John shall help to as good or to the amount of the building this where I now live, and as my son Frederic assisted in joint labour on the farm where I live, he shall share equally in the division of the improved lands Johns Labour being only in some things about the house. And my will is that they and every of my children be and continue to be in peace and to live in love and harmony together, Dutifully tender and kind to their mother and courteous to all men in the fear of God and I do constitute and appoint my two sons, John and Frederick Seybolt and my son in law Elijah Reeves, Joint Executors of this my last will and testament, and trustees of and for my above named Granddaughter Fanny Reeves and I do hereby revoke all former Wills and bequests and declare this my last Will and Testament In witness whereof I have hereunto set my hand and seal this fifteenth day of October in the year of our Lord one thousand seven hundred and eighty nine

I John M Seybolt of the Town of Mamakating County of Ulster and state of New York, yeoman Do make and publish this Codicil to my last Will and Testament in manner following Whereas in and by my last Will and Testament I have given unto my daughters therein named and to my granddaughter Fanny Reeve twenty pounds each, I do hereby order, and declare that my will is that the following sums be added thereto to wit, twenty pounds more as follows, That is to say to my daughter Fanny Vail to be paid at time and in manner as in my will is mentioned the full sum of Forty pounds to my daughter Rebekah Mulloch Forty pounds. To my daughter Phebe Reeve Forty pounds, to my daughter Catherene Osborn Forty pounds and my granddaughter Fanny Reeve in lieu of her mothers decease thirty pounds and I give unto Gabriel Reeve son of the sd mother deceased Five pounds and I give unto Keturah Reeve also daughter of the same mother five pounds. And whereas in my said will I have required that my son John should assist my son Frederic in building which for divers considerations I now revoke and will that he does not at his Johns own cost assist but in a brotherly manner, But that all my lands, be equally divided betwixt them my two sons John Seybolt and Frederic Seybolt as directed in my said Will which I give unto them their heirs and assigns forever, ordering that they pay my just debts those legacies above mentioned and render unto their mother as in my said Will during her natural life and Lastly it is my desire that this my present Codicil be annexed to and made a part of my last Will and Testament to all intents and purposes. In witness whereof I have hereunto set my hand seal this seventh day of April in the nineteenth year of the Independence of America and the year of our Lord one thousand seven hundred and ninety five.

Ulster County SS Be it remembered that on the sixteenth day of February in the year of our Lord one thousand seven hundred and ninety seven personally came and appeared before me Joseph Gusherie Surrogate of the said County, Thomas White of the town of Memecatten in the said County schoolmaster and being duly sworn on his oath declared that he did see John M Seybolt sign and seal the within written instrument purporting to be the will of the said John M Seybolt bearing date the fifteenth day of October in the year of our Lord one thousand seven hundred and eighty nine and heard him publish and declare the same as and for his last will and testament that at the time thereof he the said John M Seybolt was of sound disposing mind and memory and that Seth Mapes and Mary Reeve together with the deponent subscribed the said will as witnesses thereto in the testators presence.
