Transcription
THIS INDENTURE made the twenty Ninth day of January in the Year of our Lord One thousand Seven hundred and Ninety three BETWEEN John Ball and Jane his Wife of the Counts of Pitsylvania (sic) & Halifax of the one part and Humprey (sic) Ball of the County of Essex of the Other part. WITNESSETH that the said John Ball and Jane his Wife for and in Consideration of the Sum of Fifty five pounds twelve – Shillings to him the said John Ball in hand paid or Secured to be paid by the said Humpry (sic) Ball the receipt whereof is hereby Acknowledged, HAVE given granted Bargained and Sold and by these presents, so give grant Bargain and Sell unto the said Humphrey Ball his heirs Executors Administrators and Assigns a Certain piece or parcel of Land Situate lying and being in the County of Essex aforesaid containing by Estimation one hundred and thirty Nine Acres be the same more or less, and bounded by the Lands of William Latane William Ball, John Gatewood Reuben Garnett Joseph Gatewood Orphans & Sa—l Johnston it being the piece or parcel of Land Called Reeves’s, which he Willed to Carter Ball Dec.d Who died Intestate, leaving no Issue by Which Means the said John Ball and his Several Sisters, & Brothers William, likewise his Mother were entitled to his Estate they having entered into Bond to Stand to the division made by William Latane and Reuben Garnett being Mutually Chosen by all the sd. Parties or these Representatives, Who allotted the sd. Carter Ball Dec.d Estate in as many Lotts as their (sic) was persons entitled to his Estate & Caused them to draw for their Several proportions, and the said John Ball Drew the Lott that held the Land in sd. Division Reference thereunto being had will more fully and at Large appear TOGETHER with all Houses out Houses Gardens Orchards Ways Woods, Underwoods, profits Comodities (sic) heriditaments (sic) and appurtenances whatsoever belonging or in any Wise Appertaining and also all the Estate right Title property Claim or Demand of them the said John Ball & Jane his Wife aforesaid, their heirs Exors or Admers or any other person Whatsoever and also the Reversion and Reversions Remainder and Remainders Rents & Issues thereof and of every part and parcel thereof TO HAVE AND TO HOLD the said piece or parcel of Land and its Appurtenances unto him the said Humphrey Ball, his heirs and assigns to his and their Own proper Use Benefit and behoof forever, and the sd. John Ball and Jane his Wife for themselves and their heirs Do Covenant and Agree to and with the said Humphrey Ball and his heirs, against the Claim of them the said John Ball and Jane his Wife their heirs Exors and Admors and against the Claim of all and every other person or persons Whatsoever Shall and will Warrant and forever defend by these presents, IN WITNESS whereof the said John Ball & Jane his wife have hereunto Set their hands and Seals the day and year first above Written.Sealed and delivered John Ball (Seal)

At a Court held for Essex County at Tappahannock on the 15th Day of July 1793 This Deed indented from John Ball to Humphrey Ball was proved by W. Latane Wm Ball & John Lumpkin the Witnesses thereto, and the receipt thereon endorsed was also proved by the said W. Latane and Wm Ball also the Witnesses thereto which said Deed and receipts were Ordered to be recorded.
