This Indenture made this second day of January in the year of our Lord one Thousand Eight hundred and sixteen between Charles Lumsden and Patsey his wife of the County of Franklin and State of Virginia, James Quarles and Elizabeth his wife of the County of Wilson and State of Tennessee, James Cowden and Lucy his wife of the County of Allen and State of Kentucky and John Brown of the County of Franklin and State of Virginia Witnesseth that whereas the said Charles Lumsden and Patsy his wife, James Quarles and Elizabeth his wife, James Cowden and Lucy his wife, which said Patsey, Elizabeth & Lucy is three of the heirs and legatees of Frederick Rives Deceased for and in consideration of the sum of nine hundred and Twenty five Dollars current money of the United States to them in hand paid the Receipt whereof is hereby acknowledged, have given, granted, bargained and sold aliened, enfeoff and confirmed, and by these presents, do give, grant bargain and sell, alien, enfeoff and confirm unto the said John Brown our undivided and sixth part of and in a certain tract or parcel of land situate lying and being in the County of Franklin and State of Virginia on Pig River and its branches containing by estimation five hundred acres more or less, and which said tract of land was conveyed by Frederick Rives to his six Daughters whome the said Patsey, Sally and Lucy is three of them by decd bearing date the thirteenth day of April 1812 of record in the County Court of Franklin and bounded as follweth to wit, Beginning at Pig River at the mouth of a branch, opposit the Plantation of Burwell Rives Decd and with the line of Joseph Rives land and up the said branch with Joseph Rives line to the head cornering on a white oak, thence with Joseph Rives line to the lime stone Road cornering on a post oak the South side of the road to Lewis Hancocks line, thence South to Brows line, cornering on a chesnut tree, thence west course with Browns line to the old dividing order line, to a corner Post oak thence with Browns line South aling the dividing order line to a corner white oak at a branch, thence down the branch as it meanders to a corner maple, thence a north course to the head of second hallow below the Waggon Road crossing Plance and Pigg River to Robert Prentys line and down the said hollow to the River, and down the said River to the Beginning. To have and to hold the aforesaid undivided three sixth parts in and to the aforesaid tract or parcel of land unto the said John Brown and to his heirs and assigns forever, to the only proper use and behoof of the said John Brown, and to his heirs and assigns forever, and the said Charles Lumsden and Patsey his wife, James Quarles and Elizabeth his wife, James Cowden and Lucy his wife, do further covenant and agree to and with the said John Brown, that they the said Charles Lumsden and Patsey his wife, James Quarles and Elizabeth his wife, James Cowden and Lucy his wife the afresaid undivided three sixth part in and to the afiresaid tract of land unto the said John Brown and to his heirs and assigns shall and will by these presents warrant and forever defend. At the Clerks office of Franklin County February 5th 1816
This Indenture of Bargain and Sale between Charles Lumsden and Patsey his wife, James Quarles and James Cowden of the one part and John Brown of the other part, was acknowledged by the said Charles Lumsden. And at the Clerks office of said County July 1st 1816. The said Indenture was proved as to the said James Quarles and James Cowden by the oath of Joseph Rives a witness hereto. And at the Clerks office of said County August 5th 1816. The said Indenture was further proved as to the said James Quarles and James Cowden by the oath of Lewis Hancock and Robert Prunty two other witnesses thereto, and admitted to be recorded. And a Court held for said County January 5th 1818, Patsey Lumsden the wife of Charles Lumsden being first privately examined according to law, voluntarily relinquished her right of Dower in and to the land & Premises conveyed by the said Indenture, and Thereupon ordered to be Recorded as to her.
