Transcript

The last Will and Testament of Daniel Reeve of the town of Wallkill in the County of Orange and State of New York I Daniel Reeve considering the uncertainty of this mortal life and being of sound mind and memory (blessed be almighty God for the same) do make and publish this my last will and testament in manner and form following (that is to say)
First I order and direct my executors herein after named to pay all my just debts out of my estate
Second I give and bequeath unto my beloved wife Mary the use occupancy rents issues and proffits of all that my certain messuage or tenement with the appurtenances situate in the town of Goshen now occupied by Daniel Gale containing about one and an half acres of land until my son James Theodore shall arrive to the age of twenty one years if she shall remain my widow I also give and bequeath to her the sum of two hundred Dollars until my son James Theodore shall arrive to the age of twenty one years if the said sum of two hundred dollars or any part thereof is left at that time not expended then and at that time I give it to my said son James Theodore I also give and bequeath to my wife Mary all the household furniture which she brought with her or which I received by her since we were married also one choice cow out of y stock also one yearling heiffer I also give her the use and care of my Brass Clock until James Theodore arrives to the age of twenty one years I also give her one years provision for her and her son James Theodore which said legacys given to my said wife as aforesaid I hereby declare is intended to be and so given to my said wife in full satisfaction of and for her dower and thirds which she may or can in any waise claim or demand out of my estate
Thirdly I give and bequeath to my son James Theodore the sum of one thousand Dollars to be kept at interest by my executors secured by bond and mortgage on real estate or in any other way they may think propper until he arrives to the age of twenty one years when it shall be paid to him the interest of the above legacy shall be paid annualy to my wife Mary to be made use of by her for the education and maintenance of said James Theodore if necessary And I hereby commit the Guardianship of my said son James Theodore until he shall attain the age of twenty one years unto my said wife Mary.
Fourthly I give and bequeath to my son Gabriel Foster the sum of two hundred Dollars also I give him the sum of one hundred and fifty Dollars to be paid by him to his three oldest sons my grandchildren John William and Emmet fifty Dollars each as they shall respectively attain the age of twenty one years.
Fifthly I give and bequeath to my Daughter Belinda Gale the sum of six hundred Dollars and if the same or any part thereof should not be expended by her before her Death then the amount not expended I give to her children.
Sixth I give and bequeath to my Daughter Sophronia Minerva Hulse the sum of five hundred Dollars
Seventh I give and bequeath to my grandson Daniel Clark the sum of one hundred and twenty five Dollars to be paid to him when he attains the age of twenty one years
Eighth I give and bequeath to my grandchildren Henry Clark William Clark Patience Clark and Matilda Clark Each the sum of one hundred Dollars to be paid to them by my executors when they shall respectively attain the age of twenty one years. I hereby order and empower my executors to keep the last five mentioned legacies at interest if they can safely and pay the principal and interest to the said legacies when they shall respectively attain the age of twenty one years.
Ninth I give and bequeath to Nancy Fowler the girl brought up in my family the sum of thirty Dollars. I also give and bequeath to my Daughter Belinda Gale the bed and beding on which I now sleep.
Tenth If my son James Theodore should die without legal heirs before he attains the age of twenty one years then his property shall be equally divided between Gabriel Foster Reeve my Wife Mary Belinda Gale Sophronia Minerva Hulse and the five above named Clarks - the five named Clarks to have one share in case he James Theodore should have legal heir or heirs they shall have his property
Eleventh I hereby authorize my executor herein after named to sell the farm on which I now live of about eighty one acres to the best advantage they can and as soon after my decease as they can to advantage and empower them to give a good and sufficient deed of conveyance to the purchaser or purchasers as I myself might do if living and out of the monies derived from the same and the sale of my personal property I order them to pay all my just debts and contingent expences and also to pay the above mentioned legacies as particularly described above and in case there should be monies and property left over and above paying my debts expences &c and the above legacies I order and direct my executors to divide it in the following proportion my wife Mary Belinda Gale Sophronia Minerva Hulse and the five mentioned Clarks (the five Clarks as one) to have each one share and Gabriel Foster Reeve and James Theodore Reeve to each have two shares to the others one share apiece. If my property should fall short of paying my debts and the above legacies then each legatee shall loose their proportion of what they are to receive by the will except my son James Theodore whose legacy shall be first satisfied and I also make it binding on or obligatory on my son James Theodore to take care of and furnish my wife Mary with a good and comfortable living (if she remain my widow) during her natural life If their should be a surplus of property so that James Theodore would be entitled to a dividend agreeable to the eleventh Division then I require my wife Mary to expend it in educating him I also give bequeath and devise to my son James Theodore forever my lot of land mentioned above in the town of Goshen when he attain the age of twenty one years.
Lastly I do hereby constitute and appoint my trusty friends Calvin G Sawyer and William W Reeve executors of this my last Will and Testament In witness whereof I have hereunto set my hand and seal the twenty first day of March in the year of our Lord one thousand eight hundred and thirty nine

The above instrument consisting of two sheets was now here subscribed by Daniel Reeve the testator in the presence of each of us and was at the same time declared by him to be his last Will and Testament and we at his request sign our names hereto as attesting witnesses

The following is a codacil to my last Will & Testament
December 10 1839 Mechanictown Orange County - This is to certify that I the said Daniel Reeve hereby Devise & do agree to give my wife Mary three hundred dollars out of my estate more over and above what is in the will and it is my wish that the executors see that she have it first of any legacy and likewise all the household furniture and I wish James Theodore to have the mare and one cow and the one horse harness and for his mother to have the use of them

Whereupon I the surrogate aforesaid upon the proof aforesaid being satisfied of the genuineness & validity of the said Will do therefore order the same be admitted to probate and that Letters Testamentary thereon be granted to Calvin G Sawyer and William W Reeve executors in the said Will named they first taking the oath or affirmation required of them by Law
