This indenture made the 15th day of January in the year of our Lord one thousand Eight hundred and forty five between John Reeves of Lancaster District of the one part and James H. Witherspoon Comr in Equity for Lancaster District of the other part. Witnesseth, Whereas the said John Reeves stands indebted to the said James H. Witherspoon Comr in Equity for said District by his Bond having date even with these presents, conditioned for the payment one thousand seven hundred Sixty one Dollars 50 cents - in the following manner, viz one third on the 6th Jany 1846 also one third on the 6th Jany 1847 and also one third on the 6th Jany 1848 with Interest in the whole from 6th Jany 1845 untill paid.
Now this Indenture, Witnesseth, that the said John Reeves for and in consideration of the said debt or sum payable, as aforesaid, to the said James H. Witherspoon Comr in Equity as aforesaid and for the better securing the payments thereof to the said James H. Witherspoon Comr as aforesaid according to the times (?) (?), and also in consideration of the sum of one Dollar by him the said James H. Witherspoon Comr as aforesaid to the said John Reeves, to (?) paid it and before the sealing and delivery of these presents, do bargain, grant, sell, alien, release, (?) and confirm unto the said James H. Witherspoon Comr as aforesaid and to his heirs and assigns forever, all that piece, parcel, plantation or tract of land, situate in Lancaster District on both sides of Little Lynches Creek known as the Mike Horton tract purchased by James Reeves decd from him, containing Five hundred twenty five Acres more or less bounded by lands of Susan Caston, Michael Horton, Thos L Clyburn, Brewer and Jon Baskins having such form, marks, shape, & boundaries as a plat thereof marked A made December 1843 by B J Blackmon DS and annexed to the return of the Comrs in the case of Elisha Reeves et al vs Phillips Richardson and others represents. Reference being had to the same to more fully describe and locate said land, a copy of this plat aforesaid is also annexed to the conveyance to me from said Witherspoon Comr reference may be had to that to also describe and locate same land.
Together with all and singular the Rights Members, and Appurtenances thereto belonging or in anywise appertaining and the (?) & (?), Remainder and Remainders, Rents issues and profits thereof To have and to hold the said piece, parcel, plantation or tract of land above described with the appertenances unto the said James H. Witherspoon Comr as aforesaid & to his heirs and assigns forever, Provided Nevertheless, and it is the true intent and meaning of these presents, that if the said John Reeves or his heirs Executors or Admrs shall will and truly pay or comes to be paid unto the said James H. Witherspoon Acomr as aforesaid the sum of one thousand seven hundred thirty one Dollars & 50 cents according to the terms times & payments above mentioned (?) (?) (?) these presents shall be utterly (?) and said any therein contained to the contrary thereof in anywise notwithstanding and it is (?) and agreed upon by and between the parties to these presents, that untill default shall be made payments of the aforesaid sum as before set forth, and the Interest of the same, it shall and may be lawful to and for the said John Reeves peaceably and quietly to hold use, occupy, posses and enjoy all and Singular the premises above granted and released, and any part thereof, with the appurtenances and to have receive, and take the Rights, issues, and profits thereof to his own particular use and (?), anything herein contained to the contrary hereof in anywise notwithstanding - In witness whereof the said Parties to these presents have hereunto set their hands and seals, the day and year first above written
