Transcript

In the name of God Amen! I James Reeves of the Town of Southampton in the County of Suffolk and State of New York yeoman being mindful of my mortality do this 18th day of November in the year of our Lord one thousand eight hundred and fifty six make and publish this my last will & testament in manner following (to wit)
First I give and bequeath unto my sister Mary Reeves the use and improvement of all of my estate both real and personal during her natural life - and after the decease of my said sister Mary I give the whole of my estate as aforesaid to my brother William Reeves provided he shall then survive and in case my said brother William shall not survive my said sister Mary then in that case after the decease of my sd sister Mary I give and bequeath the whole of the estate and property as aforesaid unto my Nephew William E Reeves the son of my brother William and to his heirs & assigns forever
Secondly I do hereby constitute and appoint my brother William Reeves executor of this my last will and testament
In witness whereof I have hereunto set my hand and seal the day and year first above written

The above instrument consisting of one sheet was now here subscribed by James Reeves the testator in the presence of each of us, and was at the same time declared by him to be his last will and testament and we at his request sign our names hereto as attesting witnesses.

In the matter of proving the last will }
and testament of James Reeves } Suffolk County SS
Be it remembered, that on this 2d day of June in the year one thousand eight hundred and fifty eight before J Lawrence Smith Surrogate of the said County, personally appeared Margaret B Fithian who being by the said Surrogate duly sworn and examined, doth depose and say, that this deponent was well acquainted with James Reeves deceased that she was present, as a witness, and did see the said James Reeves deceased, subscribe at the end thereof the instrument now produced and shown to the deponent, purporting to be the last will and testament of the said James Reeves deceased, bearing date the 18th day of November in the year one thousand eight hundred and fifty six that such subscription was made by the said testator in the presence of this deponent; that the said testator at the same time declared the instrument so subscribed by him to be his last will and testament whereupon this deponent signed his name at the end thereof, at the request of the said testator; and that the said testator at the time of executing and publishing the said last will and testament, was of full age of sound mind and memory, and not under any restraint.
