To the worshipful County Court of Smith County Tenn setting at Carthage the Petition of Horace Oliver & Richard C. Sanders the first a citizen of Smith & the latter of Wilson County, Ten, against J. J. Mcglocklin, Judith J. Mcglocklin Ruth C. McGlocklin, Paulina Reeves, Adaline Reeves, James Reeves & Rhoda Reeves all citizens of Kentucky and Nancy J. Weir & her husband Joseph D. Weir, Rhoda Sanders wife of Petitioner R. C. Sanders and Tabitha Puryear all citizens of Wilson County, Tenn.
Your Petitioners want (?) show that several years ago one William Reeves departed this life in Smith County intestate leaving as his heirs at law the Defts Ruth C. married to the Deft. J. J. Mcglocklin, Paulina, Adeline, James & Rhoda Reeves all the last four being minors & have no general guardian in this State. He also left a daughter named Elizabeth who married said J. J. Mcglocklin & had one child the Deft Judith J. Mcglocklin and died leaving said Judith J. as her only heir at law. Said intestate William Reeves left a son named William who sold his interest in the tract of land hereafter to be named to your Petitioners Sanders & Oliver & conveyed the same by deed to be filed if necessary. He left another son named John who sold & conveyed by deed his interest in said land to John Reeves Senr and since that time the said John Reeves Senr has departed this life leaving a will by which his interest in said land is given to his daughters the Defts Nancy J. Weir, Rhoda Sanders and Tabitha Puryear. The tract of land referred to left by said William Reeves deceased lies in Smith County in Kenny’s bend and is bounded on the north south & west by the lands of Robert Kenny, on the South east by the lands of Thomas Kenny & east by Cumberland river and contains about two hundred acres. Your Petitioners want show that he left a widow Jemima to whom Dower has been assigned in said land, but they are informed & believe that she desires to sell her Dower and is willing for the same to be sold with the tract upon her interest being secured to her. They also learn (?) that the Defts Mcglocklin & wife & all the other parties in interest desire a sale of said land for distribution, but as they are minors or married women it was decreed best to make tem Defts: Your Petitioners want further show that said tract is of such size & so situated that it cant not be divided amongst those entitled without great injury to the respective shares. It would be manifestly to the interest of all concerned that said land should be sold for distribution. The premises considered Petitioners pray that the persons named be made Defts & that process issue for the residents & publication be made for the nonresidents & that they answer & that guardian ad litem be appointed for said minors, and on final hearing they pray for a sale of said land for distribution and they pray for general relief.
