Transcription

I Elijah C. Reeves of Jackson Township Hancock County Indiana being of sound mind and memory do make ordain publish and declare this to be my Last Will and Testament hereby revoking all other wills by me made.
1st     I direct all my Just debts to be paid
2nd     In order to pay such debts against my estate as may exist at the time of my decease excepting a certain Mortgage I direct my executor to sell my personal property and should the personal property be insufficient to pay the mortgage after paying all other debts its my request and my will that such Mortgage be resumed until such time as the sum can be paid without selling the land.
3rd     I give and bequeath to my beloved son Alva Nevil Reeves my Silver Watch and direct the same to be delivered to him when he attains the age of Seventeen years
4th     As to all my land and the residue of my personal estate after the payment of my debts excepting the above named watch I give devise and bequeath the same to my beloved wife Nancy C Reeves during her natural life in lieu of and instead of her legal interest therein and to enable her to provide for her own maintenance and the education maintenance and support of our children
5th     After the decease of my said wife I direct my estate to be equally divided among my children or their heirs
6th     I request my wife Nancy C. to keep and hold my watch until our son attains the age of seventeen years when she is to deliver the same to our said son as hereinbefore provided
7th     I hereby nominate and appoint my brother Benjamin F. Reeves Executor of this my Last Will and Testament.
In witness whereof I have hereunto set my hand and seal this third day of July A.D. 1876

Signed and acknowledged by said Elijah C. Reeves as his Last Will and Testament in our presence and signed by us as witnesses in his presence at his request and in the presence of each other this 3rd day of July 1876

Be it Remembered that on the 16th day of August 1876 Benjamin B Clift one of the subscribing witnesses to the within and foregoing last Will and Testament of Elijah C Reeves late of said County deceased personally appeared before Ephraim Marsh Clerk of the Circuit Court of Hancock County In the State of Indiana and being duly sworn by the Clerk of said Court upon his oath declared and testified as follows that is to say that on the third day of July 1876 he saw the said Elijah C. Reeves sign his name to said instrument in writing as and for his last Will and Testament and that this deponent at the same time heard the said Elijah C Reeves declare the said instrument in writing to be his last Will and Testament and that the said instrument in writing was at the same time at the request of the said Elijah C. Reeves and with his consent attested and subscribed by the said Benjamin B. Clift Thomas W. Huston in the presence of said Testator and in the presence of each other as subscribing witnesses thereto and that the said Elijah C. Reeves was at the time of signing and subscribing of the said instrument in writing as aforesaid of full age (that is more than twenty one years of age) and of sound and disposing mind and memory and not under any coercion or restraint as the said deponent verily believes and further deponents says not
