Transcription

THIS INDENTURE made the 18th day of December the year of our Lord 1767 Between Thomas Reeves of the County of Spotsylvania & Sarah his wife of the one part and James Hunter of the County of King George Esqr. Of the other part witnesseth that the said Thomas Reeves and Sarah his wife for and in Consideration of the sum of three hundred & fifty eight Pounds fifteen Shillings to the said Thomas in Hand paid by the said James Hunter Esqr. the Receipt whereof the sd. Thomas both hereby acknowledge Have Granted bargained & Sold aliened and Confirmed and by these Presents Do grant bargain & sell alien & confirm unto the sd. James Hunter Esqr. his Heirs and assigns forever all that certain Tract or parcell of Land whereon the said Thomas Reeves now lives, situate lying and being in the Parish of St. George in the County of Spotsylvania aforesd. (being three sales out of a larger Tract formerly granted to John Bowsey (by the description of one thousand six hundred and eighty acres of Land lying on the Freshes of Rappahannock River on the South side opposite to the Falls of the sd. River which after the Death of the said Bowsey was escheated & granted to Augustin Smith by Pattent bearing date the twenty second Day of October 1712 The first sale being 200 acreas (sic) more or less sold & Conveyed by the said Augustin Smith to Henry Reeves, by Deeds duly proved & recorded in the County of Essex on the 9th Day of September in the year of our Lord 1714 The second sale being one hundred acres more or less sold & conveyed by Peter Byrom to Henry Reeves the elder by Deeds duly proved & recorded in the sd. County Court of Essex on the nineteenth Day of May in the year of our Lord 1719 The third sale being fifty acres more or less sold & conveyed by Thomas Smith to George Reeves by Deeds duly proved & recorded in the County Court of Spotsylvania on the Second Day of October in the year of our Lord 1739 containing by estimation (according to the respective bounds in the sd. Three recited Deeds mentioned) three hundred & fifty acres be the same more or less which by several mesne conveyances are now legally vested in the sd. Thomas Reeves (party to these Presents (in Fee) and also all houses Edificies Buildings Gardens orchards Woods Commons Profits Commodities advantages Hereditaments and appurtenances to the sd. Messuage or Tenement & premises above mentioned – belonging or any wise appurtaining and also the Reversion & Reversions Remainder & Remainders Rents & Services of the said Premisses (sic) and every part there of all the Estate Right Title Interest Claim & Demand whatsoever of them the sd. Thomas Reeves & Sarah his wife of in and to the sd. Messuage Tenement & Premisses and every part thereof TO HAVE AND TO HOLD the said Messuage or Tenement, and all & Singular the sd. Premisses (sic) above mentioned & every part or parcel thereof with the apurtenances unto the said James Hunter Esqr. His Heirs and assigns to his and their only proper use & behoof forever, and the said Thomas Reeves for himself his Heirs executors & administrators doth covenant & grant to & with the said James Hunter Esqr. his Heirs Executors Admrs and Assigns That the sd. Thomas Reeves now is lawfully & rightfully seised in his own Right of a good sure perfect absolute & indefeasable Estate of Inheritance in fee simple ~ of & in all & Singular the above granted Premisses with the appurtenances without condition or Limitation whatsoever and that the sd. Thomas Reeves & Sarah his wife now have good Right full power & Lawfull authority to grant bargain sell & convey the above mentioned James Hunter Esqr. his Heirs & assigns to the only proper use & behoof of the sd. James Hunter Esqr. his Heirs & Assigns forever according to the true Intent and meaning of these Presents and also that he the sd. James Hunter Esqr. his Heirs and Assigns shall and may at all times hereafter peaceably & Quietly have hold occupy possess & enjoy all & Singular the sd. Messuages Lands Tenements Hereditaments & Premisses aforementioned with the appurtenances except as hereafter shall be excepted) without the Set trouble Hindrance molestation Interruption or denial of the said Thomas Reeves his Heirs or Assigns and of all & every other Person or Persons whatsoever and also for that whereas the Bounds of the fifty acres mentiond in the aforerecited Deed from Thomas Smith to George Reeves are now in dispute, it is Covenanted granted & agreed upon by & between the said Thomas Reeves & James Hunter Esqr. that the sd. Thomas Reeves doth assure & warrant the Title of the said Fifty Acres (be the same more or less according to the Boundaries in the sd. last mentioned Deed contained) Specially & only against the Title claim & Demand of him the said Thomas Reeves his Heirs or Assigns and of all and every person or persons whatsoever claiming or to Claim by from or under him the sd. Thomas Reeves his Heirs or assigns or any of them and it is further Covenanted granted & agreed upon by & between the Parties last mentioned that if the Boundaries of the sd. Last mentioned Deed shall be established so as to contain less than fifty acres then and in such case the sd. Thomas Reeves his Heirs Ex.rs or adm.rs shall repay the sd. James Hunter Esqr. for such Defficiency (sic) after the rate of twenty Shillings and six pence for every acre that shall be Deficient and also it is agreed & concluded upon that if the said Boundaries shall be established so as to contain more than fifty acres then the sd. James Hunter Esqr. shall pay the sd. Thomas Reeves for all such surplus after the same rate of Twenty Shillings & Six pence aforementioned and Lastly the said Thomas Reeves for himself his Heirs Ex.rs and Adm.rs doth covenant & grant to and with the sd. James Hunter Esqrs. His Heirs & assigns that he the said Thomas Reeves his Heirs & assigns and all & every other person and persons & his & their Heirs anything having or claiming in the said Premisses (sic) aforementioned or any part thereof by from or under him the sd. Thomas Reeves shall & will from time to time & at all times hereafter, upon the reasonable request, and at the proper Cost & Charles of the said James Hunter Esqr. his Heirs or assigns make do & execute or cause to be made done and executed all and every such further & other lawfull & reasonable act and acts Thing & Things Device & Devices conveyance and conveyances in the law whatsoever for the further better and more perfect granting conveying & assuring of all & Singular the sd. Premisses aforementioned with the appurtenances unto the said James Hunter Esqr. His Heirs and assigns to his & their only proper use & behoof forever; as by the sd. James Hunter Esqr. his Heirs or assigns or his or their Council learned in the Law shall be devised advised or required In Witness whereof the sd. Thomas Reeves and Sarah his wife have hereunto set their Hands & affixed their seals the day and year first above written ~
